AN ORDINANCE
AMENDING CHAPTER 9.36 ENTITLED STORAGE OF JUNK AND WASTE MATTER
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:
Section I. That Chapter 9.36, Section 9.36.020A of the Elgin Municipal Code,
1976, as amended, be and is hereby further amended to read as follows:
"9.36.020 Failure to Remove Unlawful
A. It is unlawful for any person who is the owner or the tenant in
possession of private property upon which is strewn or littered garbage,
debris, trash or junk, accumulated so as to constitute a danger to the public
health, to fail to remove said garbage, debris or junk after receipt of
written notice from the City's Bureau of Inspection Services."
Section 2. That all ordinances or parts of ordinances in conflict with this
ordinance be and are hereby repealed.
Section 3. That this ordinance shall be in full force and effect from and after its
passage and publication in the manner provided by law.

MEMORANDUM

SUBJECT: Burglar / Fire Alarm Control System Ordinance
PURPOSE: The purpose of this ordinance is to establish new rates, fees,
and other rights resulting from a new five-year franchise agreement that has
been awarded to ADT Security Systems.
BACKGROUND: At your October 28, 1985 regular meeting, the Council awarded
a new franchise agreement to ADT Security Systems. Basically, this new
five-year franchise agreement keeps the existing alarm system in place,
freezes the current monthly rate of $11 .50 that ADT changes to subscribers,
and increases the City' s share of that rate from .25¢/month to $7.00/month.
The attached ordinance, which has been prepared by the Legal Department,
reflects the terms of the new franchise agreement and needs to be passed by
Council prior to January 1 , 1986. It should be noted that this proposed
ordinance also would repeal the existing ordinances (refer to Section 16) .
FINANCIAL IMPACT: Passage of the proposed ordinance will result in an
increase in revenue to the City from approximately $1 ,000/year currently
to an estimated $27,300/year beginning in 1986. This amounts to over
$130,000 of additional revenue to the City over the five-year term of the
new agreement.
RECOMMENDATION: The recommendation is that the attached ordinance be passed
by Council .
