G51-80 Ordinance No. G51-80 AN ORDINANCE AMENDING THE PROVISIONS OF THE RESIDENTIAL REHABILITATION GRANT PROGRAM WHEREAS, the City of Elgin has heretofore established a residential rehabilitation grant program to encourage the rehabilitation of older housing units which are in disrepair or deterioration; and WHEREAS, the City of Elgin desires to expand the residential rehabilita- tion program to allow grants for those individuals who own dwelling units which the Building Official determines to be unfit for human occupancy; and WHEREAS, the City of Elgin is a home rule unit within the meaning of the Constitution of the State of Illinois and is authorized to exercise any power and perform any function relating to its government and affairs; and WHEREAS, it is within the government and affairs of the City of Elgin and in the interest of the public health, safety and welfare to promote the rehabilitation of the deteriorating residential buildings in the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 4 of Ordinance No. G42-77, as amended by Ordinance G28-78, as amended by Ordinance G28-79, be and is hereby amended elw to read as follows: "Applicants D. Any individual who owns a home within the City of Elgin which cannot be occupied without first securing a certificate of occupancy from the city and has been found to be a structure unfit for human occupancy by the Building Official shall be eligible for the residential rehabilitation grant program, provided that the subsequent use of the structure has been determined prior to its rehabilitation and that the individual meets all other requirements of the residential rehabilitation grant program." Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 3.
