G46-80 Ordinance No. G46-80 AN ORDINANCE GRANTING A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT AT NORTH LYLE AVENUE AND DEVONSHIRE COURT WHEREAS, written application has been made for a residential planned unit development in a R-4, general residence district, located in the vicinity of North Lyle Avenue and Devonshire Court in the City of Elgin, Illinois, on property legally described hereinafter; and WHEREAS, the Land Use Committee conducted a public hearing after due notice in the manner required by law and recommended granting a special use for a planned unit development as requested upon certain terms and conditions; and WHEREAS, the City Council of the City of Elgin has reviewed the recommendations of the Land Use Committee and concurs in said recommenda- tions. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That a special use for a residential planned unit develop- ment is hereby granted to the Windsor Development Corporation, its successors and assigns, to develop a townhouse/condominium residential project upon the following legally described territory: eft Of that part of the Southeast quarter of Section 32, Town- ship 42 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning at the Southwest corner of said Southeast quarter of Section 32; thence Northerly along the West line of said Southeast quarter, a distance of 741.06 feet to the Northerly line, extended Westerly, of Century Oaks West Unit No. 2, being a subdivision of part of Fractional Section 3, Township 41 North, and part of Section 32, Township 42 North, all Range 8 East of the Third Principal Meridian; thence Easterly, along the Northerly line, extended Westerly of Century Oaks West Unit No. 2, a distance of 1050.96 feet to the Northwest corner of Lot 83 in said Century Oaks West Unit No. 2; thence Southerly, along the Westerly lines of Lots 83, 84 and 85 in said Century Oaks West Unit No. 2, a distance of 260.0 feet to an angle in the Westerly line of said Lot 85; thence Southeasterly, along the Westerly line of said Lot 85, a distance of 116.0 feet to the most Southerly corner of said Lot 85, being also the Northwesterly corner of Lot 160 in Century Oaks West Unit No. 3, being a subdivision of part of Section 3 and 32, as aforesaid; thence Southerly, along the Westerly lines of Lots 160 and 161 in said Century Oaks West Unit No. 3, a distance of 187.95 feet to the South- west corner of said Lot 161, being also a point on the Northerly line of Lot 256 in Century Oaks West Unit No. 5, being a subdivision of part of Fractional Sections 3 and 4, Township 41 North, and part of Section 32, Township 42 North, all Range 8 East of the Third Principal eft Meridian; thence Westerly, along the Northerly lines of Lots 256, 257, 258, 259, 260 and 261 in said Century Oaks West Unit No. 5, a distance of 364.70 feet to the Northwest corner of said Lot 261, being also the Northeast corner of Lot 262 in said Century Oaks West Unit No. 5; thence Northwesterly, along the Northerly lines of Lots 262, 263 and 264 in said Century Oaks West Unit No. 5, a distnace of 271.20 feet to the most Northerly corner of said Lot 264, being also the Northeasterly corner of Lot 272 in said Century Oaks West Unit No. 5; thence Southwesterly, along the Northerly line of said Lot 272, and along said Northerly line, extended Southwesterly, a distance of 191.17 feet to the Westerly line of North Lyle Avenue, as platted in said Century Oaks West Unit No. 5; thence Southerly, along the Westerly line of North Lyle Avenue, being along a curve to the right and having a radius of 294.72 feet, a distance of 105.0 feet, thence Southerly, along the Westerly line of North Lyle Avenue, being along a curve to the right having a radius of 670.0 feet and being tangent to the last described curve, a distance of 168.07 feet to the South line of Southeast quarter of Section 32, Township and Range aforesaid; thence West- erly, along said South line, a distance of 339.95 feet to the place of beginning. Being situated in the City of Elgin, Kane County, Illinois and containing 14.943 Acres more or less. subject to the following conditions: 1. A park site contribution shall be paid to the City of Elgin in the sum of $27,360.00; said amount shall be paid in three equal installments prior to commencement of each of the three development phases of the planned unit development herein approved. 2. A school site cash contribution in the amount of $6,608.20 shall be paid to the City of Elgin; said amount shall be paid in three equal installments prior to commence- ment of each of the three development phases of the planned unit development herein approved. 3. Submission and approval of engineering plans and specifications and the posting of a performance bond prior to the issuance of any building permits. 4. On-street parking shall be prohibited and signs, as approved by the City of Elgin, shall be erected at the expense of the Windsor Development Corporation, its successors or assigns. 5. Landscaping shall be provided substantially in accord- ance with the plan prepared by the Theodore Brickman Company, dated May 8, 1980, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. 6. Filing of a reproducible recorded as-built plat within 30 days after occupancy of each of the contemplated development phases. 7. The development shall be in accordance with the Century Oaks Manor Homes building elevation plans A and B, dated June 5, 1980, a copy of which is attached hereto and made a part hereof by reference as Exhibit B. 8. The development shall be substantially in accordance with the planned unit development plat prepared by Howard A. Meadows, an Illinois Land Surveyor, dated April 24, 1980, a copy of which is attached hereto and made a part hereof by reference as Exhibit C. 9. Compliance with all other applicable ordinances or statutes. Section 2. That in granting the special use herein described, the City Council of the City of Elgin finds and determines that the planned unit development authorized herein is deemed necessary for the public convenience at the location specified in providing needed residential dwellings of the kind approved. Section 3. That the City Council of the City of Elgin further finds and determines that the planned unit development herein authorized is so designed, located and proposed to be operated that the public health, safety and welfare will be protected through limitation on architectural design, the preservation of open space and compatibility with natural geographic features. Section 4. That the City Council of the City of Elgin further finds and determines that the planned unit development will not cause substantial injury to the value of other property in the neighborhood in which it is located because the planned unit development authorized is compatible with surrounding land uses. eft Section 5.
