G30-80 Ordinance No. G3O-80 AN ORDINANCE GRANTING A SPECIAL USE FOR LIME RESIDUE STORAGE WHEREAS, written application has been made for a special use permit to allow storage of lime residue in the southwest quadrant of the State Hospital site hereinafter legally described; and WHEREAS, the Land Use Committee conducted a public hearing after due notice as required by law and recommended that the application be denied; and WHEREAS, the City Council of the City of Elgin does not concur in the recommendations of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council of the City of Elgin hereby finds and determines that the requested special use is necessary for the public conven- ience at the proposed location because the Illinois Environmental Protection Agency ordered the disposal of lime residue from the water treatment process to be made in a sanitary landfill and that no landfill within 20 miles of the City of Elgin is prepared to accept such lime waste residue and that no feasible alternative site is available. Section 2. That the City Council of the City of Elgin further finds and determines that the proposed landfill is so designed, located and proposed to be operated that the public health, safety and welfare will be protected in that the special use requested will be for a limited period of time, land- scaping and screening will be provided and the Illinois Institute of Natural Resources, by letter of January 29, 1980 has determined that disposal of lime sludge from the water treatment plants of the City of Elgin is unlikely to have any adverse effect on the ground water supply in the area. Section 3. That the City Council of the City of Elgin further finds and determines that the proposed special use will not cause substantial injury to the value of other property in the neighborhood in which it is located as improvements to surrounding property are sufficiently removed to be uneffected by the proposed special use and will be buffered by required screening and landscaping. Section 4. That a special use be and is hereby granted for the establish- ment and maintenance of a sanitary landfill for the storage of lime residue from water treatment plants operated by the City of Elgin upon the following described property: That part of the Southeast Quarter of Section 22 and the North- east Quarter of Section 27 all in Township 41 North, Range 8 East of the Third Principal Meridian described as follows: Commencing at the Northwest corner of said Northeast Quarter of Section 27; thence Easterly along the North line of said Northeast Quarter of Section 27 for a distance of 343.2 feet, more or less, to the Westerly line of the Elgin Mental Health Site for the place of beginning; thence North- erly along said Westerly line for a distance of 300.0 feet; thence Easterly, along a line perpendicular to the right with the prolonga- tion of the last described course, for a distance of 880.0 feet; thence Southerly, along a line perpendicular to the right with the prolongation of the last described course, for a distance of 735.0 feet; thence Westerly, along a line perpendicular to the right with the prolongation of the last described course, for a distance of 880.0 feet to the Westerly line of the Elgin Mental Health Site; thence Northerly along said Westerly line for a distance of 435.0 feet to the place of beginning. Being situated in the City of Elgin, Kane County, Illinois. subject to termination after a period of three years, submission and approval of a specific landscape plan by March 15, 1980, installation of approved landscaping by June 30, 1980 and compliance with all Illinois Environmental Protection Agency screening requirements and submission of a petition for a larger long-term site. Section 5. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law and shall be published in pamphlet form by authority of the City Council. s/ Richard L.
