G22-80 Ordinance No. G22-80 AN ORDINANCE AMENDING THE PENALTIES FOR THE,VIOLATION ,OF CERTAIN,ORDINANCES REGULATING THE KEEPING OF DOGS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 7.04 of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by adding Section 7.04.055 entitled "Penalty for Violation" to read as follows: "7.04.055 Penalty for Violation Any person alleged to have violated any of the provisions of Section 7.04.040 through 7.04.050 may settle and compromise that claim by paying to the City within five days after receipt of notice of the alleged violation the sum of ten ($10.00) dollars for the first offense and fifteen ($15.00) dollars for a second offense. The first or second time any dog is caught while running at large with a current license attached to its collar or harness shall, if possible, be returned by the animal control officer to its owner or keeper. If the owner or keeper cannot be located, the dog does not have its current license on its collar or it is the third offense within one year, the dog shall be declared a nuisance and shall be impounded as provided for in Section 7.04.080 and/or t r the person accused shall be subject to the penalty as provided in 7.04.140." Section 2. That Section 7.04.060(A) of Chapter 7.04 of the Elgin Municipal Code, 1976, as amended, is hereby repealed. Section 3. That Section 7.04.060(B) of Chapter 7.04 of the Elgin Municipal Code, 1976, as amended, is hereby renumbered Section 7.04.045. Section 4. That Section 7.04.080 of Chapter 7.04 of the Elgin Municipal Code, 1976, as amended, is hereby amended to read as follows: "7.04.080 Impoundment -- Recemption -- Fees A. Licensed Dogs. Any dog for which the license fee for the current year has been paid, which may during such year be impounded or taken up for being at large, may be redeemed by the owner or keeper of such dog upon payment of a fee to the city of ten dollars for the first redemption, fifteen dollars for the second redemption and twenty-five dollars for the third redemption, for the taking up or impounding of such dog, and in addition, paying the cost of keeping such dog while impounded. If such dog is without a collar or harness with a current license attached, it shall be deemed a licensed dog for the purpose of this section if satisfactory proof is given to a police officer, or the animal control officer, by the owner or keeper that such dog is licensed and that a collar, or harness with a current license tag attached thereto was placed on such dog, but had subsequently been lost or taken from such animal. B. Unlicensed Dogs. Any unlicensed dog which has been impounded may be redeemed by the owner or keeper of such dog upon payment to the city of the sum of fifteen dollars for the first redemption, twenty-five dollars for the second redemption, 41, and thirty dollars for the third redemption, as a fee for taking up or impounding such dog, plus the annual license fee provided in Section 7.04.020, and the cost of keeping such dog while im- pounded."
