AN ORDINANCE
AMENDING CHAPTER 11.44 ENTITLED "PARKING METERS"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:
Section 1. That Section 11.44.010 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is amended to read as follows:
"11.44.010 Parking Meter Installation
A. The Finance Director or his designee shall establish
parking spaces in the parking zones hereinafter described. Each
parking space shall be indicated by markings on the street pave-
ment or curb and shall have a parking meter installed adjacent
to each parking space.
B. Each parking meter shall display a signal showing
legal parking upon the deposit of the appropriate coin or coins,
lawful money of the United States of America, for the period of
time prescribed by this chapter. Each parking meter shall
indicate by a proper visible signal that the lawful parking
period has expired and in such cases the right of such vehicle
to occupy such space shall cease."
Section 2. That Section 11.44.030 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is hereby repealed.
Section 3. That Section 11.44.020 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is hereby renumbered Section 11.44.030.
Section 4. That Section 11.44.030 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is hereby amended by adding Subsection D to
read as follows:
"D. When the motor vehicle is not entirely within the
designated parking space."
Section 5. That Section 11.44.020 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is hereby added to read as follows:
"11.44.020 Parking Meter Operation
Except in compliance with the directions of a police officer
or traffic control sign or signal, when any vehicle shall be parked
in any parking space, the operation of such vehicle shall, upon
entering the said parking meter space, immediately deposit or cause
to be deposited in said meter such proper coin as is required for
such parking meter and as is designated by proper directions on the
meter. Upon the deposit of such coin the parking space may be law-
fully occupied by such vehicle during the period of time which has
eft been prescribed for that parking space, provided that any person plac-
ing a vehicle in a parking space adjacent to a meter which indicates
that unused time has been left in the meter by the previous occupant
of the space shall not be required to deposit a coin so long as his
occupancy of said space does not exceed the indicated unused parking

time. If said vehicle shall remain parked in any such parking
space beyond the parking time limit set for such parking space,
and if the meter shall indicate such illegal parking, then, and
in that event, such vehicle shall be considered as in violation
of Section 11.44.050."
Section 6. That Section 11.44.040 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is amended to read as follows:
"11.44.040 Off-Street Parking Facilities
The following regulations shall govern the use of off-street
parking facilities owned, controlled and operated by the City:
A. The parking rates shall be collected 24 hours a day seven
days a week except from 7:00 A.M. to 1:00 P.M. on Sunday.
B. The chief of police shall cause the removal as provided
in Section 11.36.200 of any vehicle found abandoned, parking in
violation of this title for a period of more than twenty-four
hours, or obstructing the ingress or egress of other vehicles
using an off-street parking facility.
C. No person shall remain in any municipal parking lot
longer than is reasonably necessary to park or remove a motor
vehicle. Warning signs shall be erected in all municipal parking
lots prohibiting persons from remaining in said lots longer than
is reasonably necessary to park or remove a motor vehicle. Any
person who shall remain in any municipal parking lot for more than
five minutes and who shall have been directed by a police officer
of the city to leave said parking lot shall be guilty of a viola-
tion of this section and shall be subject to a fine of not less
than twenty-five dollars nor more than five hundred dollars."
Section 7. That Section 11.44.050 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is amended by adding Subsection B to read
as follows:
"B. It is unlawful to deposit in any parking meter any coin
for the purpose of parking beyond the maximum legal parking time
for the particular parking zone."
Section 8. That Section 11.44.090 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is amended to read as follows:
"11.44.090 Deputy Collectors--Appointment of Duties
The Finance Director shall employ deputy collectors to make
regular collections of coins deposited in the parking meters. Such
person shall be capable of making repairs to such meters and shall
furnish a surety bond in the amount of one thousand dollars condi-
tioned for the faithful performance of his duties as such collector."
Section 9. That Section 11.44.100 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is amended to read as follows:
"11.44.100 Thirty-minute Parking Zones
A. The following streets and areas shall be thirty-minute
parking zones:
Brook Street, east side thereof, from North Street to Water
Street, the southerly four spaces.
Douglas Avenue, east side thereof, from Dexter Avenue to
Division Street.
Douglas Avenue, east side thereof, from Division Street to
East Highland Avenue, the northerly one space and the southerly
one space.
Douglas Avenue, east side thereof, from East Highland Avenue
to East Chicago Street, the northerly one space and the southerly
one space.
Douglas Avenue, west side thereof, from East Highland Avenue
to East Chicago Street.
North Spring Street, west side thereof, from Kimball Street
to North Street, the southerly one space.
South Spring Street, west side thereof, from East Chicago

North Grove Avenue, west side thereof, from East Highland
Avenue northerly for one block.
North State Street, west side thereof, from West Highland
Avenue to West Chicago Street.
South State Street, east side thereof, from West Chicago

Avenue.

Chicago Street Bridge, between South State Street and River-

B. The maximum legal parking in the above described parking zones
shall be limited to a period not to exceed two hours.
C. The deposit of $0.05 shall entitle the person parking his car
in the above described parking zones to legally park for a period of
thirty minutes."
Section 10. That Section 11.44.110 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is amended to read as follows:
"11.44.110 One-hour Parking Zones
A. The following streets and areas shall be one-hour parking
zones:
Douglas Avenue, east side thereof, from Division Street to East
Highland Avenue, except the northerly one space and the southerly one
space.
Douglas Avenue, east side thereof, from East Highland edik to East Chicago Street, except the northerly one space and the
southerly one space.
South Spring Street, east side thereof, from DuPage Street to
Fulton Street.
B. The maximum legal parking in the above described parking zones
shall be limited to a period not to exceed two hours.
C. The deposit of $0.10 shall entitle the person parking his
car in the above described parking zones to legally park for a period
of one hour."
Section 11. That Section 11.44.120 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is amended to read as follows:
"11.44.120 Two-hour Parking, Zones
A. The following streets and areas shall be two-hour parking
zones:
Douglas Avenue, east and west side thereof, from Kimball Street
to North Street.
Douglas Avenue, east side thereof, from North Street to Dexter
Avenue, southbound to the alley.
North Spring Street, west side thereof, from Kimball Street to
North Street, except the southerly one space.
North Spring Street, west side thereof, from Dexter Avenue to
Division Street.
North Spring Street, east side thereof, from Dexter Avenue to
Division Street, southerly from the alley.
North Spring Street, west side thereof, from Division Street
to East Highland Avenue.
Villa Street, east and west side thereof, from East Chicago
Street to DuPage Street.
North Street, south side thereof, from North Grove Avenue to
Brook Street.
North Street, north side thereof, from Douglas Avenue to
North Spring Street.
Division Street, south side thereof, from Douglas Avenue to

car in the above described parking zones to legally park for a period
of one hour."
Section 12. That Section 11.44.130 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is amended to read as follows:
"11.44.130 Five-hour Parking Zones
A. The following streets and areas shall be five-hour parking
zones:
Douglas Avenue, east side thereof, from Dexter Avenue to North
Street, northerly to the alley.
North Spring Street, east side thereof, from North Street to
Dexter Avenue.
Division Street, south side thereof, from North Spring Street
to Center Street.
East Chicago Street, north side thereof, from Center Street to
Geneva Street.
East Chicago Street, south side thereof, from Villa Street to
Geneva Street, except the westerly two spaces.
Chicago Street Bridge from South State Street to Riverside
Drive, except the westerly one space.
Municipal Parking Lot at Fulton Street and Villa Street.
B. The deposit of $0.10 shall entitle the person parking his
car in the above described parking zones to legally park for a period
of one hour." All
Section 14. That Section 11.44.140 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is amended to read as follows:
"11.44.140 Ten-hour Parking Zones - Ten Cents Per Hour
A. The following streets and areas shall be ten-hour parking
zones:
Dexter Avenue, south side thereof, from North Spring Street to
Center Street.
Highland Avenue Bridge, south side thereof, from South State
Street to Riverside Drive.
West Highland Avenue, south side thereof, from Crystal Street
to North State Street.
Municipal Parking Lot at the southwest corner of North Street
and Douglas Avenue.
B. The deposit of $0.10 shall entitle the person parking his
car in the above described parking zones to legally park for a period
of one hour."
Section 15. That Section 11.44.150 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is amended to read as follows:
"11.44.150 Ten-hour Parking Zones - Five Cents Per Hour
A. The following streets and areas shall be ten-hour parking
zones:
Water Street, south side thereof, from Brook Street to North
Grove Avenue.
North Street, north side thereof, from North Grove Avenue
to Brook Street.
North Street, north side thereof, from North Spring Street
to Center Street.
Center Street, east side thereof, from North Street to Dexter
Avenue.
Brook Street, east and west side thereof, from Water Street
to Kimball Street.
South State Street, west side thereof, from South Street to
Locust Street, except southerly from the railroad right of way.

Division Street, north and south side thereof, from Center
Street to Tennyson Court.
East Highland Avenue, north and south side thereof, from Center

B. The deposit of $0.05 shall entitle the person parking his
car in the above described parking zones to legally park for a period

of one hour."
Section 16. That Section 11.44.160 of Chapter 11.44 of the Elgin
Municipal Code, as amended, is amended to read as follows:
"11.44.160 Civic Center Parking Zone
A. The Finance Director may, in lieu of parking meters, pro-
vide for attendant parking, whereby the time of entry and exit to
that parking zone shall be determined and parking fees shall be based
on the amount of time that the vehicle was located in that zone.
B. That the following hours are established for operation of the
civic center parking zone (bounded by Douglas Avenue, Highland Avenue
and North Grove Avenue) :
a. Monday and Thursday: 8:00 AM to 10:00 PM
b. Tuesday, Wednesday, Friday and Saturday: 8:00 AM to
6:30 PM
c. Christmas Season (Thanksgiving to December 25) :
8:00 AM to 10:00 PM
C. That the following rates be and are hereby established for
parking in the civic center parking zone:
a. First three hours, 10¢ per hour or fraction thereof.
b. Each additional hour or fraction thereof, 25(t
c. Maximum daily fee, $1.55. Hourly fees shall apply from
8:00 AM to the time of exiting the lot up to a maximum of $1.55
for each day regardless of the number of hours parked if the
ticket is not presented upon exiting.
D. It shall be unlawful to park any vehicle over 20 feet in
length in any one parking space or to park a vehicle in such a way
that it requires more than one parking space.
E. That there is hereby established a system of validation stamps
to be distributed to participating merchants for a fee of l0ct each by
and under the direction of IDEA. A fee of 8¢ for each validation stamp
be and is hereby established."
Section 17. That Chapter 11.48 entitled "Municipal Parking Lots" of the
Elgin Municipal Code, as amended, is hereby repealed.
Section 18. That Section 11.72.040(A) of Chapter 11.72 of the Elgin
Municipal Code, as amended, is hereby amended to read as follows:
"A. Any person accused of a violation of chapters 11.32, 11.36,
11.40 and 11.44, except sections 11.44.050 and 11.44.070, may settle
and compromise the claim for such illegal parking by paying to the
City the sum of ten dollars ($10.00) within ten days from the time
, • .
such alleged offense was committed. Any person accused of violating
Section 11.44.050(A) may settle and compromise the claim for such
illegal parking by paying to the City the sum of one dollar ($1.00)
within forty-eight hours of the time such offense was committed, or by
paying to the City the sum of two dollars ($2.00) subsequent to said
forty-eight hour period and prior to such person being charged by
written complaint or notice to appear for such violation. Any person
accused of violating Section 11.44.050(B) may settle and compromise the
claim for such illegal parking by paying to the City the sum of five
dollars ($5.00) within forty-eight hours of the time such offense was
committed, or by paying to the City the sum of ten dollars ($10.00)
subsequent to said forty-eight hour period and prior to such person
being charged by written complaint or notice to appear for such viola-
tion."
Section 19. That this ordinance shall be in full force and effect from
and after its passage and publication in the manner provided by law.
