G7-79 Ordinance No. G7-79 emw AN ORDINANCE REGULATING THE KEEPING OF DOGS WITHIN THE CITY OF ELGIN BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Title 7, Chapter 7.04 of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by adding the following: "7.04.055 No person, firm or corporation shall have or keep more than three dogs over four months of age on their property within the corporate limits of the City of Elgin unless it is lawfully established and licensed as a pet shop." Section 2. That Title 6, Chapter 6.81 of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended to read as follows: "6.81 Pet Shops 6.81.010 Definitions. 'Pet Shop' shall mean any establishment engaged in the busi- ness of breeding, buying, selling or boarding of dogs, cats, birds, mice or other small animals within a completely enclosed building with no outside facilities or accessory structures for animals. 6.81.020 License--Required--Fee. It is unlawful to operate a pet shop anywhere in the city without having first obtained a license therefor. The annual fee for such license shall be twenty-five dollars. 6.81.030 Wholesome premises required. Every place used as a pet shop shall be kept in a clean and sanitary condition. No refuse or waste material shall be allowed to remain thereon for more than twenty-four hours. All animals therein shall be humanely treated, and any animal having a contagious disease shall be isolated and properly treated." Section 3. That Title 19, Chapter 19.04 of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended to read as follows: "19.04.210 Dog kennel. 'Dog Kennel' means a facility where four or more dogs over four months of age are boarded, bred and/or offered for sale." Section 4. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 5.
