G52-79 Ordinance No. G52-79 r- AN ORDINANCE AMENDING THE PROVISIONS OF THE ELGIN ZONING ORDINANCE RELATING TO THE NUMBER OF VOTES REQUIRED FOR APPROVAL OF SPECIAL USES AND AMENDMENTS WHEREAS, a written application has been made to amend Sections 19.48.030B and 19.52.020 of the Elgin Municipal Code, 1976, as amended, to delete the requirement of an extraordinary majority to approve applica- tions not recommended to the corporate authorities; and WHEREAS, the Elgin Planning Committee conducted a public hearing on said application after due notice in the manner provided by law; and WHEREAS, the Elgin Planning Committee recommended that the application be denied; and WHEREAS, the City Council of the City of Elgin has reviewed the recommendation of the Elgin Planning Committee and does not concur in said recommendation and finds that the proposed application is in the best interest of the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 19.48.030B of the Elgin Municipal Code, 1976, as amended, be and is hereby amended by deleting subparagraph B therefrom and revising said section to read as follows: "19.48.030 Authority--Procedure. Special uses may be authorized by the city council, pro- vided that no application for a special use shall be acted upon by the city council until after the following acts: 1. A public hearing has been held after due notice by publication as provided by statute; and 2. A written report containing findings of facts and recommendations prepared by the planning committee and/or land use committee is forwarded to the city council." Section 2. That Section 19.52.020 of the Elgin Municipal Code, 1976, as amended, be and is hereby amended by deleting therefrom the following language: "No amendment which is not recommended to the city council shall be made except upon a vote of two-thirds of the corporate authorities." Section 3. That this ordinance shall be in full force and effect ten eik days after its passage and publication in pamphlet form by authority of the City Council. s/ Richard L. Verbic Richard L.
