AN ORDINANCE
AMENDING THE PROVISIONS OF THE ELGIN MUNICIPAL CODE RELATING
TO THE SALE OF ALCOHOLIC LIQUOR
WHEREAS, the City of Elgin has constructed and improved the Fountain
Square Plaza Mall for the benefit and enjoyment of the citizens of Elgin;
and
WHEREAS, the sale of alcoholic beverages with food adds to the enjoy-
ment and promotes the use of the Fountain Square Plaza Mall; and
WHEREAS, the City of Elgin is a home rule unit authorized to exercise
any power and perform any function relating to its government and affairs.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Section 6.06.050 of Chapter 6.06 of the Elgin Municipal
Code, as amended, is hereby amended by adding the following:
"I. Class H. For the retail sale of alcoholic liquor
on the Fountain Square Plaza Mall pursuant to a lease for
said premises entered into between the licensee and the City
of Elgin for consumption on the premises only, one hundred
dollars. No Class H license shall be issued to any person
who does not have a Class A license for adjoining premises."
Section 2. That Section 6.06.150 of Chapter 6.06 of the Elgin Municipal
Code, as amended, is hereby amended to read as follows:
"P. Fail to comply with any term or condition contained
in the lease for the premises of a Class H license."
Section 3. That this ordinance shall be in full force and effect ten
days after its passage and publication and shall be published in pamphlet
form by authority of the City Council.
