G28-79 Ordinance No. G28-79 AN ORDINANCE AMENDING AN ORDINANCE ESTABLISHING A RESIDENTIAL REHABILITATION GRANT PROGRAM WHEREAS, the City of Elgin has heretofore established a residential rehabilitation grant program to encourage the rehabilitation of older housing units which are in disrepair or deterioration; and WHEREAS, the City of Elgin desires to expand the geographical area con- sidered for residential rehabilitation to include those individuals which the Department of Housing and Urban Development has determined to be within their guidelines as low income; and WHEREAS, the City of Elgin is a home rule unit within the meaning of the Constitution of the State of Illinois and is authorized to exercise any power and perform any function relating to its government and affairs; and WHEREAS, it is within the government and affairs of the City of Elgin and in the interest of the public health, safety and welfare to promote the rehabilitation of the deteriorating residential buildings in the City of Elgin. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: "Section 3. Establishment. There is hereby established a residential rehabilitation grant program for the City of Elgin.'.' Section 2. That Section 2 of Ordinance G28-78 passed on April 12, 1978 be and is hereby amended to read as follows: "Section 4. Applicants. The following applicants shall be eligible for grants for the renovation and rehabilitation of qualifying residential structures to meet minimum housing code requirements in accordance with the terms of the residential rehabilitation grant program: A. Any individual within the neighborheod strategy area who: 1. Owns a structure containing no more than four dwelling units; 2. Is at least 18 years of age; 3. Has owned the structure eligible for the residential rehabilitation grant program for at least 180 days. B. Any individual outside the neighborhood strategy area but within the corporate limits of the City of Elgin who: 1. Owns and occupies a structure containing no more than four dwelling units; 2. Is at least 18 years of age; 3. Has owned the structure eligible for the residential rehabilitation grant program for at least 180 days; 4. Who meets the Department of Housing and Urban Develop- ment's current Section 8 low income guidelines. C. Any non-profit child-care institution within the corporate limits of the City of Elgin as defined in the Child Care Act of 1969, Illinois Revised Statutes, 1977, Chapter 23, Section 2211, which has been in full operation in the City of Elgin for not less than one year." Section 3. That Section 3 of Ordinance G28-78 passed on April 12, 1978 be and is hereby amended to read as follows: "Section 5. Grants. A. Individuals within the neighborhood strategy area. The amount of any grant for owner-occupied dwelling units shall be determined by the Department of Community Development in accordance with the current grant reimbursement chart. The amount of any grant for non-occupant owners shall be a 15 percent rebate; limited to a maximum rebate of $1,500 per structure, or the rebate percentage as it applies to a maximum of $10,000 construction costs. Non-occupant owners shall be limited to two (2) structures actively participating in the rebate program. Any owner-occupant of a 2, 3 or 4 unit residential structure or any non-occupant owners must provide tenant's names and addresses and agree to maintain current rents for one (1) year from the date of completion. Partial rebates for completed repairs,that are part of the residential rehabilitation program for qualifying structures, may be granted if participation can be shown to be dependent on a staging of the repairs as where a commercial loan for the total improvements has been denied. B. Individuals outside the neighborhood strategy area and within the corporate limits. The amount of any grant shall be determined by the Department of Community Development in accordance with the current grant reimbursement chart, in con- junction with Housing and Urban Development Section 8 low income guidelines. The amount of any grant shall not exceed $5,000 or the determined rebate percentage as it applies to a maximum of $10,000 construction costs. C. Child care institutions within the corporate limits. The grant shall be 25 percent of the eligible repairs, insula- tion or painting not to exceed $2,500 per structure or the rebate percentage as it applies to a maximum of $10,000 construc- tion costAer structure. There shall be no grant for labor performed by-the resident or other personnel of the institution. No partial grants shall be allowed. Child care institutions shall be allowed one grant every three years which shall be restricted to two residential structures where more than day care services are provided. Grants shall not fund structural changes to accommodate special uses such as elevators, relocation of partitions or facilities, remodeling, fire sprinklers or construction or modifications mandated by municipal, state or federal require- ments. D. Grants shall be made until funds allocated for such use are exhausted. For purposes of determining eligibility, income shall mean the total of the adjusted gross income as defined by the Internal Revenue Code of the United States and, in addition thereto, state, municipal and other interest not included in the adjusted gross income, any capital gain deduction, any dividend exclusion, if not applicable in the adjusted gross income, to all members of the household of individual applicants." Section 4. That Section 5 of Ordinance G28-78 passed on April 12, 1978 be and is hereby amended to read as follows: "Section 1. Eligible Area-Neighborhood Strategy Area Defined. The neighborhood strategy area shall be limited to the following described area within the corporate limits of the City of Elgin: Commencing at Jefferson Avenue and Grove Avenue, east on Jefferson Avenue to Liberty Street, thence south to Franklin, thence east to Grand Boulevard to the Kane-Cook County line, elk thence south to Hammond Avenue, thence west to Grace Street, thence north to Bluff City Boulevard, thence west to Raymond Street, thence north to U.S. Route 20, thence west to the Fox River, thence north to Lake Street, thence west to Wellington, thence north to Prairie, thence east to Geneva Street, thence north to Highland Avenue, thence west to Center Street, thence north to Park Street, thence west to Spring Street, thence north to Kimball Street, west to Brook Street, north to Seneca Street, west to Grove Avenue, and north to Jefferson, the place of beginning, otherwise known as U.S. Census tracts 8513, 8514 and that portion of 8515 east of the Fox River."
