G27-78 Ordinance No. 8 eft AN ORDINANCE G27-7 GRANTING A SPECIAL USE FOR THE ESTABLISHMENT AND OPERATION OF A DAY CARE CENTER AT 69 NORTH ALDINE AVENUE WHEREAS, written application has been made for a special use permit for the establishment and operation of a day care center on the premises commonly known as 69 North Aldine Avenue, Elgin, Illinois; and WHEREAS, the Land Use Committee conducted a public hearing after due notice in the manner provided by law; and WHEREAS, the Land Use Committee has recommended that the special use permit requested be granted subject to certain conditions; and WHEREAS, the City Council of the City of Elgin concurs in the recommenda- tions of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That it finds and determines that the granting of a special use permit for the establishment and operation of a day care center at 69 North Aldine Avenue, Elgin, Illinois, is necessary for the public convenience at that location to serve the demand for day care facilities throughout the community and that the proposed day care center is so designed, located and proposed to be operated that the public health, safety and welfare will be protected in that adequate off-street parking spaces will be provided, a suitable means of ingress and egress will be provided, the rear yard will be fenced and the hours of operation limited, and that the proposed use will not cause substantial injury to the value of other property in the neighborhood in which it is located because of the limitations on the use and the nature of adjoining property in the neighborhood consisting of adjacent apartment build- ings to the south and an office building to the east. Section 2. That a special use permit be and is hereby granted to Patrick J. Hannell and Katherine R. Bannell for the establishment and operation of a day care center on the premises commonly known as 69 North Aldine Avenue, Elgin, : Illinois, and legally described as follows: The Westerly 165 feet of Lots 8 and 9 of Block 1, Pleasant Home Addition to Elgin, in the City of Elgin, Kane County, Illinois. subject to the following conditions: a. That six off-street parking spaces shall be constructed in accordance with the ordinances of the City of Elgin. b. That the proposed play area in the rear shall be defined by a four-foot fence, c. That hours of operation shall be limited to permit use of the subject property for day care operations overnight and weekends. d. That vehicular ingress and egress shall be provided substantially in accordance with Exhibit A, attached hereto and made a part hereof by reference. e. That the proposed day care center authorized shall be constructed substantially in accordance with Exhibit B, which is attached hereto and made a part hereof by reference. Section 3.
