G11-78 • Ordinance No. G11-78 AN ORDINANCE AMENDING CHAPTER 3.28 OF THE ELGIN MUNICIPAL CODE, 1976 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 3.28 of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended to read as follows: "3.28 Greater Downtown Elgin Commission 3.28.010 Created There is created the Greater Downtown Elgin Commission for the purpose of advising and recommending to the City Council policy guidelines for the development and promotion of the Central Business District including the Fountain Square Plaza Mall. 3.28.020 Members - Appointment The commission shall consist of twelve members to be appointed by the City Council. One commissioner shall be an owner or representa- tive of an owner of real property in the Central Business District, but not within Special Service Area Number 1; one commissioner shall be an owner or representative of an owner of real property in the Central Business District; two commissioners shall be businessmen or merchants doing business in Special Service Area Number 1; one member shall be a consumers' representative chosen at large from the city; one member shall be a representative of the Elgin Chamber of Commerce; one member shall be a representative of the Downtowners, Inc. ; one member shall be the executive director of the In Downtown Elgin Association; and the following persons shall be ex officio members of the commission: a member of the City Council, the city engineer, the director of public property and recreation, and the executive vice-president of the Elgin Area Chamber of Commerce. 3.28.030 Members - Terms A. Initial appointments shall expire as follows: 1. Four members on May 1, 1979; 2. Three members on May 1, 1980. B. All succeeding terms shall be for a two-year period. If during the term of a commissioner he is no longer eligible or able to act as a commissioner, then the office shall become vacant and the City Council shall appoint a successor for the unexpired term. 3.28.040 Meetings The commission shall meet at least once each month and shall make an annual written report to the City Council concerning its activities. • • 3.28.050 Powers and duties The Greater Downtown Elgin ,: Commission shall have the following powers and duties, in addition to any other which may be granted by the City Council: A. To develop and recommend to the City Council policy guidelines for the development of the Central Business District by the promotion of recreational, cultural and special activities. B. To review and approve permit applications for the use by vendors in the Fountain Square Plaza. C. To recommend to the City Council an annual budget for the operation, maintenance and improvement of the Fountain Square Plaza, which shall be submitted no later than October 15 of each year. D. To review, recommend and coordinate graphics, signage, land- scaping and architectural changes in the Central Business District so as to promote the theme of the Fountain Square Plaza and to improve the aesthetics of the entire Central Business District. E. To recommend approval of an executive director to provide coordination and to carry out the day-to-day activities of the commission, These duties shall be carried out under the general supervision of the Director of Public Property and Recreation. The executive director shall attend and report at all meetings of the commission. The duties of the executive director shall be: 1. To solicit and coordinate all events and activities on Fountain Square Plaza Mall and in the Central Business District. 2. To recruit and supervise all Fountain Square Plaza Mall concessionaires. 3. To develop and recommend appropriate policies or policy changes for the continued development of the Central Business District and the Fountain Square Plaza Mall. 4. To perform other such duties as directed by the Director • of Public Property and Recreation and the Greater. Downtown Elgin Commission." Section 2. That Chapter 3.28 of the Elgin Municipal Code, 1976, as amended, entitled "Fountain Square Plaza Mall Commission" be and is hereby repealed. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law. s/ Richard L.
