G61-77 Ordinance No. G61-77 elk AN ORDINANCE GRANTING A SPECIAL USE FOR AN OPEN SALES LOT AT 750 EAST CHICAGO STREET WHEREAS, written application has been made for a special use to allow the use of the premises located at 750 East Chicago Street, Elgin, Illinois, as a used car lot; and WHEREAS, after due notice as required by law the Elgin Land Use Committee conducted a public hearing and recommended approval of the application subject to certain conditions; and WHEREAS, the City Council has reviewed the transcript of the public hear- ing and the recommendations of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That a special use be and is hereby granted to permit the use of the premises located at 750 East Chicago Street, Elgin, Illinois, and legally described as follows: Lot 13 of Lord's Park Terrace, a part of Lot 16 of the County Clerk Subdivision in the Southwest Quarter of Section 18, Hanover Township, Cook County, Illinois. as a used car lot and for automobile repairs subject to the following condi- tions: A. Not less than nine off-street parking spaces shall be pro- vided on the premises which shall be properly marked and landscaped according to the provisions of the off-street parking ordinance of the City of Elgin. B. That a set back of 5 feet shall be maintained along Chicago Street. C. That the drive approach nearest to Willard Avenue shall be removed and replaced with curb and landscaping as shall be approved by the Department of Community Development. D. Existing pump islands shall be removed and the existing paved surface shall be repaired and covered with a one inch overlay of asphaltic concrete. E. No alterations shall be made to the exterior of the struc- ture other than ordinary maintenance and repair. F. All repair work shall be conducted wholly within the existing structure. G. No damaged or wrecked motor vehicles shall be stored out- side. H. No more than 42 motor vehicles shall be displayed on the lot at any given time. I. That all signs shall conform to the sign ordinance of the City of Elgin and no roof signs shall be permitted. J. That after the closing of the business, no lighting other than usual and customary security lighting shall be permitted. K. No body, fender or painting shall be performed on the premises. L. The existing fence on the west property line shall be extended to the north property line and shall be constructed of similar materials and of the same height as the existing fence. M. Motor vehicles displayed along East Chicago Street shall be displayed a sufficient distance from the lot line to insure safe ingress and egress of motor vehicles from the residential property located to the west. Section 2. The City Council hereby finds that the special use herein granted is necessary for the public convenience at the location proposed and locating such uses in the vicinity of one another along East Chicago Street and converting the unused premises to a use consistent with surrounding uses. The City Council further finds that the proposed use upon the conditions herein recited is so designed, located and proposed to be operated that the public health, safety and welfare will be protected and that such conditions promote the use of the subject property in a manner compatible with surround- ing property. The City Council further finds that the proposed special use will not cause substantial injury to the value of other property in the neighborhood in which it is located and that the surrounding territory is classified for business uses and the subject property was the site of an automobile service station which is not dissimilar to the proposed special use. Section 3. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law and shall be published in pamphlet form by authority of the City Council. s/ Richard L.
