G58-77 Ordinance No. G58-77 AN ORDINANCE REGULATING TREE BANK PARKING BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. The Elgin Municipal Code, 1976, as amended, be and is hereby further amended by adding Section 11.04.515 to Chapter 11.04 to read as follows: "11.04.515 Tree Bank 'Tree Bank' means that area between the curb, the extended curb or lateral roadway line and the property line." Section 2. The Elgin Municipal Code, 1976, as amended, be and is hereby further amended by adding Section 11.36.030(E) to Chapter 11.36 to read as follows: (Except when necessary to avoid conflict with other traffic, or in compliance with law or the directions of a police officer or official traffic-control device, no person shall:) "11.36.030(E) Park or stand a vehicle on a tree bank except: 1. In business or manufacturing districts, on an existing tree bank paved with Portland Cement Concrete or Bituminous Concrete unless that vehicle is: r a) blocking the sidewalk b) encroaching on travel lanes c) blocking a public or private driveway d) within fifteen feet of a fire hydrant e) within twenty feet of a cross walk at an intersection f) within thirty feet upon the approach to any flashing signal, stop sign or traffic control signal located at the side of a roadway g) within twenty feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within seventy-five feet or said entrance 2. In residential districts, where the tree bank is not curbed, parallel parking or standing to the curb line on the tree bank shall be permitted unless it violates another parking regulation of this title. eft 3. A vehicle may not park or stand on a tree bank at any place where official signs prohibit standing or parking on the street and/or tree bank." Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law. s/ Richard L.
