AN ORDINANCE
AMENDING ORDINANCE NO. G6-74 TO ADD TO THE USES PERMITTED ON
A CERTAIN LOT IN THE NORTH ELGIN INDUSTRIAL PLAZA
WHEREAS, Ordinance No. G6-74 was passed on February 27, 1974 pursuant
to the terms of certain annexation agreements, as amended, entered into by
and between the City of Elgin and the owners of record of the real property
described in said ordinance; and
WHEREAS, said annexation agreements, as amended, provided for certain
uses on Lot 18 and other lots located upon said property; and
WHEREAS, an amendment to said annexation agreements has been entered
into by and between the City of Elgin and the owner of said Lot 18.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That there is hereby added to Section lA of Ordinance
No. G6-74, passed on February 27, 1974, as amended on April 10, 1974, the
following:
"5. In addition to the provisions of Subsection 1 to 4 of
this section, Lot 18 shall be permitted for use as an auction
center upon the following conditions:
1. At the time of construction of any auction
center upon said Lot 18, not less than 60 parking
spaces shall be provided in accordance with the
applicable ordinances of the City of Elgin.
2. Not later than five years following the
issuance of a certificate of occupancy for use of
an auction center on Lot 18 or at such time as any
auction center established on Lot 18 shall be expanded,
not less than 72 additional parking spaces shall be
provided in accordance with the applicable ordinances
of the City of Elgin."
Section 2. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law.
