G46-77 Ordinance No. G46-77 AN ORDINANCE GRANTING A SPECIAL USE FOR THE DEVELOPMENT OF A PLANNED UNIT DEVELOPMENT FOR RESIDENTIAL PURPOSES WHEREAS, written application has been made for a special use for the development and maintenance of a planned unit development for residential purposes upon certain property hereinafter described and located in the City of Elgin; and WHEREAS, the Land Use Committee conducted a public hearing on said application after due notice as required by law; and WHEREAS, the Land Use Committee recommended that the special use requested be granted subject to certain conditions; and WHEREAS, the City Council of the City of Elgin concurs in the recom- mendation of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council finds that the proposed residential planned unit development is necessary for the public convenience at the location proposed in providing single family dwellings in an area designated and intended for such uses. Section 2. That the City Council further finds that the proposed resi- dential planned unit development is so designed, located and proposed to be operated that the public health, safety and welfare will be protected in that said development will be completed substantially in accord with the sub- division ordinance and zoning ordinance. Section 3. That the City Council further finds that the proposed resi- dential planned unit development will not cause substantial injury to surround- ing property as said use will consist of single family dwellings similar to the surrounding neighborhood. Section 4. That a special use for a residential planned unit development on the following legally described property: That part of the Northeast Quarter of Section 18, Township 41 North, Range 9 East of the Third Principal Meridian, described as follows: Commencing at the Northeast corner of said Northeast Quarter; thence South 00° 00' 00" West along the East line of said Northeast Quarter, 157.99 feet to the point of beginning; thence continuing South 00° 00' 00" West along said East line, 999.15 feet to the North line of Corley Drive as dedicated with Parkwood Unit No. 4; thence North 90° 00' 00" West along said North line, 250.29 feet; to the Southeast corner of Lot 355 in Parkwood Unit No. 4; thence North 00° 00' 00" East, along the East line of said Lot 355, 140.00 feet to the Northeast corner thereof; thence North 90° 00' 00" West, along the North line of Lots 353, 354 and 355 in Parkwood Unit No. 4 aforesaid, 165.00 feet to a point on the Easterly line of Parkwood Unit No. 3; thence North 28° 00' 00" West along said Easterly line, 250.00 feet; thence continuing along said Easterly line, North 00° 00' 00" East, 80.0 feet; thence con- tinuing along said Easterly line, North 26° 32' 58" East, 160.00 feet; thence continuing along said Easterly line, North 09° 32' 58" East, 190.00 feet to the Northeast corner of Lot 258 in Parkwood Unit No. 3 aforesaid; thence South 86° 32' 58" West, along the North line of said Lot 258, 130.00 feet to the East line of Hunter Drive as dedicated with Parkwood Unit 3 aforesaid; thence North 000 00' 00" East, along said East line 245.00 feet; thence North 90° 00' 00" East, 69.76 feet to a point of curvature; thence Southeasterly along a curve to the right having a radius of 200.00 feet, an arc distance of 115.11 feet (the chord thereof bearing South 73° 30' 42" East, 113.53 feet) ; thence North 86° 32' 58" East 381.45 feet, more or less, to the point of beginning, in Hanover Township, Cook County, Illinois and containing 10.5831 acres. be and is hereby granted to U.S. Shelter subject to the following conditions: (1) Construction of 46 single family dwelling units in accordance with the development plan, attached hereto and made a part hereof by reference. (2) Construction and dedication of streets and cul-de- sacs in accordance with the subdivision ordinance. (3) Submission and approval of a final site plan illustrating building locations on each lot in accordance with applicable ordinances. (4) Construction shall be commenced wtihin one year after approval by the City Council for each phase receiving final plat approval. (5) Development and maintenance shall be in accordance with all provisions of the subdivision ordinance, building code, zoning ordinance, and all other applicable ordinances. (6) Submission and approval of engineering plans and specifications and the required performance bond prior to any construction. (7) Compliance with the school site contribution require- ments prior to any construction. (8) All cul-de-sac streets shall have a 50 foot right-of- way and a pavement width of 28 feet face-to-face. (9) All right-of-way widths at cul-de-sac turn-arounds shall be 105 feet, with a pavement width of 80 feet face-to- face. (10) Center islands, at cul-de-sac turn-arounds, shall have a 25 foot diameter, back-to-back. (11) Cul-de-sac circular pavement widths shall be 27 feet face-to-face. eft (12) Cul-de-sac center islands shall contain a mail box, street light, fire hydrant, and landscaping. (13) Sidewalks on cul-de-sac streets shall not be required. (14) All curbs and gutters on cul-de-sac streets shall be in accordance with engineering specifications for Type B6.12 curb and gutter. (15) All streets other than cul-de-sacs shall have a 60 foot right-of-way, a 34 foot pavement width face-to-face and 4 foot sidewalks on each side of the street. (16) All streets other than cul-de-sac streets shall have curb and gutter in accordance with engineering specifications for Type B6.18 curb and gutter. (17) All dwellings shall have a two car garage. (18) All driveways shall be not less than 24 feet long from the back of curb to the front of the garage. (19) All lots shall have a minimum width of 50 feet at the building line. (20) All lots shall conform in size to the lot areas shown on the development plan. (21) There shall be a minimum 15 foot front yard setback on cul-de-sac streets. (22) There shall be a minimum 25 foot front yard setback on all other streets. (23) There shall be a minimum 30 foot rear yard setback. (24) There shall be a minimum 3 foot sideyard setback. (25) No fences shall be allowed within sideyards. (26) Concrete driveways shall be provided. (27) U.S. Shelter shall submit to the engineering division pavement design requirements for streets and driveways in accordance with engineering specifications as provided for in the subdivision regulations. (28) Not less than two trees meeting city standards shall be planted on each lot. f (29) A dedication plat shall be submitted to the City of Elgin for the entire northeast detention area described in Exhibit B, attached hereto and made a part hereof by reference. Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. A certified copy of this ordinance shall be filed with the Recorder of Deeds of Cook County, Illinois, at petitioners expense. Section 4. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law and shall be published in pamphlet form by order of the City Council. s/ Richard L.
