G44-77 Ordinance No. G44-77 AN ORDINANCE GRANTING A SPECIAL USE FOR A GROUP HOME FOR CHILDREN AT 113 PLUM STREET WHEREAS, written application has been made for a special use to permit the operation of a group home for children on the premises commonly known as 113 Plum Street, Elgin, Illinois; and WHEREAS, the Land Use Committee conducted a public hearing on said application after due notice as required by law; and WHEREAS, the Land Use Committee recommended that the special use requested be granted subject to certain conditions; and WHEREAS, the City Council of the City of Elgin concurs in the recom- mendations of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council hereby finds that the proposed special use is necessary for the public convenience at the location proposed in pro- viding a group home for children in the R-4, General Residence District; The City Council further finds the proposed use is so designed, located and proposed to be operated that the public health, safety and welfare will be protected by adequate supervision and operation substantially as a single family dwelling; The City Council further finds that the proposed use will not cause sub- stantial injury to property in the neighborhood in which it is located, in that a group home for children is compatible with surrounding uses. Section 2. That a special use permit be and is hereby granted to Larkin Childrens Home to permit the use of the property commonly known as 113 Plum Street and legally described as follows: The East 70.75 feet and the North half of Lot 2, Block 35, in P. J. Kimball, Jr. 's Third Addition to the City of Elgin, Kane County, Illinois. as a group home for not more than six children. Section 3. That the special use herein granted shall terminate at such time as Larkin Childrens Home may cease ownership or operation of the group home herein permitted. Section 4. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law. s/ Richard L . Verbic Richard L.
