G41-77 Ordinance No. G41-77 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF ELGIN WHEREAS, written application has been made to amend the zoning ordinance of the City of Elgin to permit the use of portable signs as defined in the zoning ordinance; and WHEREAS, a public hearing was held by the Planning Committee to consider amendment of the Elgin zoning ordinance concerning the use of portable signs; and WHEREAS, the Planning Committee has recommended that the zoning ordinance be amended to permit portable signs under certain circumstances and for limited periods of time; and WHEREAS, the City Council of the City of Elgin has reviewed the recommendations of the Planning Committee and concurs in the recommendations of the Planning Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Section 19.04.565(24) of the zoning ordinance of the City of Elgin be and is hereby amended by amending the definition of "Temporary Sign" to read as follows: "24. TEMPORARY SIGN. Any sin banner,g , , pennant, valance, or other advertising display constructed of cloth, canvass, light fabric, cardboard, wallboard or other light material with or without frames, and portable signs, as otherwise defined herein, for use for a period not to exceed thirty (30) days." Section 2. That Section 19.45.020(E) be amended to read as follows: "E. Portable Signs. Portable signs, except as may be permitted under the authority for temporary signs." Section 3. That Section 19.45.100 is amended by amending subsection "A" to read as follows: "A. Temporary signs and attention-getting devices as defined in this ordinance are permitted for special promotions, including special community activities, grand events or annual sales or special activities of non-profit organizations subject to the following pro- visions: 1. Size: No temporary sign shall exceed 32 square feet in area. 2. Number: Not more than one temporary sign shall ( be permitted upon any parcel of property. 3. Permit Limitations. Temporary sign permits shall be limited to a period not to exceed thirty (30) days and not more than two permits shall be issued within a twelve (12) month period. One additional permit shall be permitted for a grand opening in the case of substantial new construction, or a permitted change in ownership or operation of an existing use. The duration of a temporary permit may be extended by the enforcement official where a temporary sign is being used in lieu of a permitted sign otherwise permitted under this ordinance, where the applicant files satisfactory proof showing that a permitted sign meeting the requirements of this ordinance will be erected within a reasonable period of time." Section 4. That all ordinances or parts of ordinance in conflict with the provisions of this ordinance be and are hereby repealed. Section 5. That this ordinance shall be in full force and effect ten days after its passage and publication in pamphlet form by authority of the City Council. s/ Richard L. Verbic Richard L.
