AN ORDINANCE
ESTABLISHING FEES FOR THE CONNECTION AND USE OF CERTAIN WATER
MAIN IMPROVEMENTS
WHEREAS, the City of Elgin has caused certain water main improvements to
be made and identified as Hoxie Avenue and Lawrence Avenue Water Main Extension;
and
WHEREAS, the City of Elgin has installed the following improvements:
A connected system of twelve inch (12") cast iron water mains herein pro-
vided for and described as Hoxie Avenue Water Main Extension, Elgin, Kane
County, Illinois, complete with gate valves, vaults hydrants and all cast
iron fittings constructed within public streets, all described as follows:
A twelve inch (12") water main, from and connected with an existing twelve
inch (12") water main, at a point approximately eighteen feet (18') northwest
of the intersection of the centerlines of Highland Avenue and Hoxie Avenue.
Thence northerly for a distance of four hundred and seventy two feet
(472') and parallel with the center line of Hoxie Avenue at a distance of ten
feet (10') west of the center line of Hoxie Avenue to a point.
Also, a twelve inch (12") water main connected with another twelve inch
CL2") water main installed as a part of this project, the point of beginning
being sixteen feet (16') northwest of the intersection of the centerlines of
Lawrence Avenue and Hoxie Avenue.
Thence easterly for a distance of two hundred and sixty feet (260') and
parallel with the centerline of Lawrence Avenue and eleven feet (11') south of
the north right-of-way line of Lawrence Avenue connected with an existing
twelve inch (12") water main.
and
WHEREAS, the cost of said improvements to the City of Elgin is approximately
$5,284.70; and
WHEREAS, said improvements extend across property located within the City
of Elgin for a distance of 430 lineal feet; and
WHEREAS, the City of Elgin is a home rule unit empowered to exercise any
power or perform any function pertaining to its government and affairs; and
WHEREAS, it is reasonable to require owners of property adjoining said
improvement to bear a proportionate share of the cost of said improvement in
the event that said owners desire to connect to and use said water mains.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
TLLTNOIS:
Section 1. That any owner of property adjoining the above described
Hoxie Avenue and Lawrence Avenue Water Main Extension who desires to connect
to and use said facilities shall pay to the City Treasurer of the City of
Elgin, Illinois, a fee in an amount determined at the rate of $12.29 per
front foot of such owner's property adjoining said improvement. Said fee
shall be in addition to any and all other fees established by the City of
Elgin for water service.
Section 2. That in accordance with the provisions of Section 1 of this
ordinance the following amounts are established to be paid for connection to
property adjoining the Hoxie Avenue and Lawrence Avenue Water Main Extension.

That part of the Northwest Quarter of Section 15, Township 41 North,
Range 8 East of the Third Principal Meridian described as follows:
Commencing at the Northeast corner of said Northwest Quarter;
thence Westerly, along the North line of said Northwest Quarter,
a distance of 1386.15 feet, more or less to the Westerly right-of-
way line of Hoxie Avenue; thence Southerly, along said Westerly
right-of-way line, a distance of 422.3 feet for the place of
beginning; thence continuing along the last described course, a
distance of 417.3 feet to the Northeast corner of Lot 1 of Turner's
Corner being a subdivision in said Northwest Quarter; thence in a
Westerly direction, along the North line of said Lot 1, a distance
of 184 feet; thence in a Northeasterly direction, along a prolonga-
tion of the West line of Turner's Corner, a distance of 91.07 feet;
thence Westerly, in a straight line, a distance of 204 feet; thence
Northerly, in a straight line, a distance of 330 feet to a point,
said point being 422 feet South of the North line of said Northwest
Quarter and 377.14 feet West of the place of beginning; thence in an
Easterly direction a distance of 377.14 feet to the place of beginning.
Being situated in Elgin Township, Kane County, Illinois, and contain-
ing 3.21 acres more or less. 848.01

Section 3. That adjoining properties held in common ownership shall be
subject to payment of an amount based upon the frontage of all said properties
when application for connection for any of said lots is made.
Section 4. That any person desiring to pay for said water main improve-
ment prior to January 1, 1978 may pay said amount in full without interest.
Section 5. That any person desiring to hook on to said water main improve-
ment shall pay an amount equal to not less than 20% of the amount established
for the property to be served plus interest at the rate of 7% of the total
amount due accruing from and after January 1, 1978 to the date of payment.
Section 6. That after connection and partial payment as provided in this
ordinance an additional 20% of the total amount due plus interest at the rate
of 7% of the total balance due since the last payment shall be made on January 1
of each succeeding year until the total amount is paid.
Section 7. That a certified copy of this ordinance shall be recorded with
the Recorder of Deeds of Kane County, Illinois.
Section 8. That all ordinances or parts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
Section 9. That this ordinance shall be in full force and effect from and
after its passage and approval in the manner provided by law and shall be
published in pamphlet form by authority of the City Council.
