G35-77 Ordinance No. G35-77 AN ORDINANCE CLASSIFYING CERTAIN NEWLY ANNEXED TERRITORY WHEREAS, the territory herein described has been annexed to the City of Elgin pursuant to the terms of an annexation agreement between the City of Elgin and the owners of record of said territory; and WHEREAS, the annexation agreement concerning said territory provides that the City of Elgin shall proceed to classify the territory in accordance with its terms; and WHEREAS, all required public hearings have been conducted and all notices required to be given by law have been given. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 19.08, Section 19.08.020, entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map', as amended, be and are hereby altered by including in R-2, Single-Family Residence District, the 14 following described property: That part of Fractional Section 4, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning at the Northwest corner of Northern Illinois Gas Company property; thence Northerly at right angles to the North line of said Northern Illinois Gas Company property by deed dated February 9, 1954 as Document No. 743751, a distance of 171.59 feet; thence Northwesterly along a curve to the right having a radius of 245.0 feet; (the chord of said curve forms an angle of 74 degrees 45 minutes 45 seconds to the left with the prolongation of the last described course) , a distance of 42.41 feet; thence Northwesterly tangent to the last described curve, a distance of 391.98 feet; thence Northeasterly at right angles to the last described course, a distance of 197.51 feet; thence Northwesterly along a line that forms an angle of 53 degrees 35 minutes 29 seconds to the left with the prolongation of the last described course, a distance of 172.0 feet; thence North- westerly along a line that forms an angle of 18 degrees 36 minutes 27 seconds to the right with the prolongation of the last described course, a distance of 66,0 feet; thence Northeasterly along a curve to the left having a radius of 397.0 feet; (the chord of said curve forms an angle of 83 degrees 48 minutes 59 seconds to the right with the prolongation of the last described course) , a distance of 85.69 feet; thence Northeasterly tangent to the last described curve, a distance of 203.90 feet; thence North- westerly along a line that forms an angle of 72 degrees 22 minutes 49 seconds to the left with the prolongation of the last described course, a distance of 44.23 feet; thence Northeasterly along a line that forms an angle of 21 degrees 26 minutes 46 seconds to the right with the prolongation of the last described course, a distance of 228.00 feet; thence Easterly along a line that forms an angle of 68 degrees 16 minutes 12 seconds to the right with the prolongation of the last described course, a distance of 101.56 feet; thence Northerly along a line that forms an angle of 88 degrees 28 minutes to the left with the prolongation of the last described course, a distance of 20 feet more or less to the North line of the Northeast Quarter of Fractional Section 4 as aforesaid; thence Westerly along said North line, a distance of 1471.91 feet to the Northeast corner of a tract of land conveyed to Sydney G. and Alice J. Burnidge by deed dated March 31, 1958 and recorded April 2, 1958 in Book 1886, page 128 as Document No. 858655; thence Southerly along the Easterly line of said Burnidge property, a distance of 1025.51 feet; thence Easterly at right angles to the last described course, a distance of 130.0 feet; thence Southerly at right angles to the last described course, a distance of 10.0 feet; thence Southeasterly along a curve to the left having a radius of 180.0 feet and being tangent to the last described course, a distance of 202.11 feet to a point on a line that is 785.0 feet Northeasterly of, measured at right angles thereto, and parallel with the center line of Big Timber Road; thence Southeasterly along said parallel line, a distance of 505.0 feet; thence Southeasterly a distance of 81.0 feet to a point on a line that is 790.0 feet Northeasterly of, measured at right angles thereto, and parallel with the center line of Big Timber Road; thence Southeasterly along Al) said parallel line, a distance of 510.0 feet; thence Southeasterly, Fatterly and Northeasterly along a curve to the left having a radius of 60.0 feet, the chord of said curve forms an angle of 3 degrees 22 minutes 38 seconds to the left with the prolongation of the last described course, a distance of 144.0 feet; thence Southeasterly, a distance of 132 feet more or less to a point on the Westerly line of Northern Illinois Gas Company property by deed dated February 9, 1954 as Document No. 743751, that is 871.41 feet Southwesterly of (as measured along said Westerly line) the place of beginning; thence Northeasterly along said Westerly line, a distance of 871.41 feet to the place of beginning. Being situated in the City of Elgin, Kane County, Illinois and containing 46.7 acres more or less." Section 2. That Chapter 19.08, Section 19.08.020, entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map' , as amended, be and are hereby altered by including in R-3, Two-Family Residence District, the following described property: That part of Fractional Section 4, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Commenc- ing at the Northwesterly corner of Northern Illinois Gas Company property as conveyed by deed dated February 9, 1954 and recorded in Book 1668, page 27 as Document No. 743751; thence Southwesterly along the Westerly line of said Northern Illinois Gas Company property, a distance of 871.41 feet for the place of beginning; thence continuing Southwesterly along the last described course, a distance of 130.0 feet to a point on a line that is 635.0 feet Northeasterly of, measured at right angles thereto, and parallel with the center line of Big Timber Road; thence Northwesterly along said parallel line, a distance of 1606.06 feet to the Easterly line of a tract of land conveyed to Sydney G. and Alice J. Burnidge by deed dated March 31, 1958 and recorded April 2, 1958 in Book 1886, page 128 as Document No. 858655; thence Northeasterly along said Easterly line, a distance of 192.64 feet to an angle in said Easterly line; thence Northerly along said Easterly line, a distance of 30.0 feet; thence Easterly at right angels to the last described course, a distance of 130.0 feet; thence Southerly at right angles to the last described course, a distance of 10.0 feet; thence Southeasterly along a curve to the left having a radius of 180.0 feet and being tangent to the last described course, a distance of 202.11 feet to a point on a line that is 785.0 feet Northeasterly of, measured at right angles thereto, and parallel with the center line of Big Timber Road; thence Southeasterly along said parallel line, a distance of 505.0 feet; thence Southeasterly a distance of 81.0 feet to a point on a line that is 790.0 feet Northeasterly of, measured at right angles thereto, and parallel with the center line of Big Timber Road; thence Southeasterly along said parallel line, a distance of 510.0 feet; thence Southeasterly, Easterly and North- easterly along a curve to the left having a radius of 60.0 feet, the chord of said curve forms an angle of 3 degrees 22 minutes 38 seconds to the left with the prolongation of the last described course, a distance of 144.0 feet; thence Southeasterly a distance of 132 feet more or less to the place of beginning. Being situated in the City of Elgin, Kane County, Illinois and containing 5.8 acres more or less." Section 3. That Chapter 19.08, Section 19.08.020, entitled "Zoning District Map" of the Elgin Municipal Code, 1976, as amended, be and the same is hereby further amended by adding thereto the following paragraph: "The boundaries hereinbefore laid out in the 'Zoning District Map' , as amended, be and are hreby altered by including in R-4, General Residence District, the following described property: That part of Fractional Section 4, Township 41 North, Range 8 East of the Third Principal Meridian, described as follows: Commenc- ing at the Northwesterly corner of Northern Illinois Gas Company property as conveyed by deed dated February 9, 1954 and recorded in Book 1668, Page 27 as Document No. 743751; thence Southwesterly along the Westerly line of said Northern Illinois Gas Company property, a distance of 1001.41 feet to a point on a line that is 635.0 feet Northeasterly of, measured at right angles thereto, and parallel with the center line of Big Timber Road for the place of beginning; thence continuing Southwesterly along said Westerly line, a distance of 664.70 feet to the center line of Big Timber Road; thence Northwesterly along said center line, a distance of 1610.72 feet to the Easterly line of a tract of land conveyed to Sydney G. and Alice J. Burnidge by deed dated March 31, 1958 and recorded April 2, 1958 in Book 1886, page 128 as Document No. 858655; thence Northeasterly along said Easterly line, a distance of 663.34 feet to a point on a line that is 635.0 feet Northeasterly of measured at right angles thereto, and parallel with the center line of Big Timber Road; thence Southeasterly along said parallel line, a distance of 1606.06 feet to the place of beginning. Being situated in the City of Elgin, Kane County, Illinois, and containing 23.45 acres more or less." Section 4. That this ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law and shall be published in pamphlet form by authority of the City Council. s/ Richard L .
