G31-77 Ordinance No. G31-77 AN ORDINANCE GRANTING A SPECIAL USE FOR A TRANSITIONAL CARE PROGRAM FOR EX-DRUG ABUSERS WHEREAS, written application has been made for a special use to permit the operation of a transitional care program for ex-drug abusers at 695 South State Street, Elgin, Illinois; and WHEREAS, the Land Use Committee conducted a public hearing on said application after due notice as required by law; and WHEREAS, the Land Use Committee recommended that the special use requested be granted; and WHEREAS, the City Council of the City of Elgin concurs in the recommenda- tions of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That it hereby finds and declares that the proposed special use for a transitional care program for ex-drug abusers is necessary for the public convenience in providing the community with a necessary service not otherwise available; The City Council further finds and declares that the proposed use is C ty p p so designed, located and proposed to be operated that the public health, safety and welfare will be protected in that adequate staff and supervision will be provided; The City Council further finds and declares that the proposed special use will not cause substantial injury to the value of other property in the neighborhood in which it is located in that the proposed use is not anticipated to increase traffic, hours of operation will be limited, and patient capacity is limited. Section 2. That a special use is hereby granted to the Community Concern for Alcoholism and Drug Abuse for the operation of a transitional care program for ex-drug abusers at the premises located at 695 South State Street, Elgin, Illinois, and legally described as follows: Part of Lot 4, County Clerk's Subdivision in the City of Elgin, Kane County, Illinois. subject to the condition that the facility shall not be used as a place of residence by any individual and the program shall not be conducted during late night and early morning hours. Section 3. That the special use herein granted shall terminate upon cessation of the proposed transitional care program for former drug abusers by. Community Concern for Alcoholism and Drug Abuse.
