AN ORDINANCE
PROVIDING AN ICE CREAM CONCESSIONAIRE ON THE FOUNTAIN SQUARE PLAZA MALL
WHEREAS, the Fountain Square Plaza Mall Commission has determined
that a concessionaire selling ice cream products will promote the use of
the Mall.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That Section 6.46.050 of Chapter 6.46 of the Elgin
Municipal Code, as amended, is hereby amended by adding the following:
"H. There shall be one 12 month license for the sale of
ice cream products."
Section 2. That Section 6.46.060(A) of Chapter 6.46 of the Elgin
Municipal Code, as amended, is hereby amended to read as follows:
"A. For the sale of popcorn and peanuts, hot dogs and
related goods, flowers, ice cream products, the fee shall be
prepaid in monthly installments of $50.00 for the months of
April through October and $10.00 for all other months."
Section 3. That the Purchasing Agent shall place a notice of the
availability of this new license in the Daily Courier-News at least seven
days before the license will be granted on June 7, 1977 at the regular
meeting of the Mall Commission. Applications will be accepted by the
Purchasing Agent until 11:00 A.M. , Monday, June 6, 1977.
Section 4. That all ordinances or parts of ordinances in conflict
with the provisions of this ordinance be and are hereby repealed.
Section 5. That this ordinance shall be in full force and effect from
and after its passage and approval in the manner provided by law.
