G8-76 Ordinance No. G8-76 r AN ORDINANCE GRANTING A SPECIAL USE FOR A TRANSIT FACILITY AT 9 NORTH GROVE AVENUE, ELGIN, ILLINOIS WHEREAS, written application has been made for a special use permit to operate and maintain a transit facility at the property commonly known as 9 North Grove Avenue, Elgin, Illinois; and WHEREAS, the Plan Commission has considered said application and sub- mitted its recommendations to the Zoning Board of Appeals and the City Council; and WHEREAS, the Zoning Board of Appeals has held a public hearing after due notice as required by law and has recommended that said special use permit be granted; and WHEREAS, the City Council has considered the recommendations of the Plan Commission and the Zoning Board of Appeals. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS Section 1. That the City Council hereby finds and determines that the proposed special use for a waiting room for bus passengers is necessary for the public convenience at that location in providing a centrally located shelter for patrons of the City transit facilities; The City Council further finds that said special use is so designed, located and proposed to be operated that the public health, safety and welfare will be protected and that said use will be supervised by employees of the City of Elgin; The City Council further finds that said use will not cause substantial injury to the value of other property in the neighborhood in which it is located as such use is located in the central business district of the City of Elgin and will provide a suitable place for patrons to wait and will reduce congestion around storefronts in the immediate vicinity. Section 2. That this special use be and is hereby granted to the City of Elgin to maintain and operate a bus waiting area at 9 North Grove Avenue, Elgin, Illinois, and legally described as follows: Part of Lots 3 and 4, Block 14, James T. Gifford's Plat of Elgin in the City of Elgin, Kane County, Illinois. subject to the following condition: That this location shall not be considered permanent but rather for interim use until the City realizes a more permanent facility such as the proposed intermodal transportation facility.
