G7-76 Ordinance No. G7-76 AN ORDINANCE GRANTING A SPECIAL USE FOR A TRANSIT FACILITY AT 200 BROOK STREET, ELGIN, ILLINOIS WHEREAS, written application has been made for a special use permit to operate and maintain a transit facility at the property commonly known as 200 Brook Street, Elgin, Illinois; and WHEREAS, the Plan Commission has considered said application and sub- mitted its recommendations to the Zoning Board of Appeals and the City Council; and WHEREAS, the Zoning Board of Appeals has held a public hearing after due notice as required by law and has recommended that said special use permit be granted; and WHEREAS, the City Council has considered the recommendations of the Plan Commission and the Zoning Board of Appeals. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. The City Council hereby finds and determines that the proposed special use for a transit facility at 200 Brook Street, Elgin, Illinois, is deemed necessary for the public convenience at that location in providing a centrally located transit facility for intercity transpor- tation; The City Council further finds that the special use is so designed, located and proposed to be operated that the public health, safety and welfare will be protected in that said use will be located in an industrial area and will be subject to limitations on parking and will not interfere with traffic or the uses of surrounding property; The City Council further finds that it will not cause substantial injury to the value of other property in the neighborhood in which it is located as the subject property is located within a manufacturing district and the proposed use is compatible with otheruses in the district. Section 2. That a special use permit be and is hereby granted to James R. Williams to maintain and operate a transit facility at 200 Brook Street, Elgin, Illinois, and legally described as follows: Lots 79 through 83, P. J. Kimball Jr's. 2nd Addition in the City of Elgin, Kane County, Illinois. subject to the following conditions: 1. That no buses shall be parked on North Street; (ow 2. That loading shall be allowed only on the west side of Brook Street, between North Street and Water Street; and 3. That the special use herein granted shall expire 180 days after completion of the proposed intermodal transportation facility. Section 3. That the special use herein granted shall be limited to the operation of a Greyhound bus terminal and shall not otherwise be assignable or transferable without the consent of the City of Elgin. Section 4. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law. s/ Harry W.
