G43-76 Ordinance No. G43-76 AN ORDINANCE GRANTING A SPECIAL USE FOR A CHURCH AND PARSONAGE AT 4 NORTH STATE STREET WHEREAS, written application has been made for a special use to permit the operation of a church and parsonage on the premises commonly known as 4 North State Street, Elgin, Illinois; and WHEREAS, the Land Use Committee conducted a public hearing on said application after due notice as required by law; and WHEREAS, the Land Use Committee recommended that the special use requested be granted subject to certain conditions; and WHEREAS, the City Council of the City of Elgin concurs in the recommendations of the Land Use Committee. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council hereby finds that the proposed special use is necessary for the public convenience at the location proposed in providing a church and parsonage in the B-3, Service Business District; The City Council further finds the proposed use, if granted, subject to the conditions recommended by the Land Use Committee, is so designed, located and proposed to be operated that the public health, safety and welfare will be protected; The City Council further finds that the proposed use will not cause substantial injury to the property, or to the property in the neighborhood in which it is located, in that a church and parsonage is compatible with surrounding uses. Section 2. That a special use permit be and is hereby granted to permit the use of the property commonly knonw as 4 North State Street and legally described as follows: The North 22 feet of the South 44 feet of the East 90 feet of Lot 12, Block 29, William C. Kimball's Plat of Elgin in the City of Elgin, Kane County, Illinois. as a church and parsonage subject to the following conditions: 1. That two apartments on the subject property shall be converted into a single dwelling unit for the use of the minister only. 2. That no residential use shall be permitted for any future use in the event that the church relocates. Section 3.
