G12-76 Ordinance No. G12-76 eft AN ORDINANCE GRANTING A SPECIAL USE FOR A FIRE STATION AND DRILL FACILITY AT THE NORTHEAST CORNER OF BIG TIMBER ROAD AND MORNINGSIDE DRIVE IN THE CITY OF ELGIN, ILLINOIS WHEREAS, written application has been made for a special use permit to operate a fire station and drill facility at the northeast corner of Big Timber Road and Morningside Drive in the City of Elgin, Illinois; and WHEREAS, the Plan Commission has considered said application and sub- mitted its recommendations to the Zoning Board of Appeals and the City Council; and WHEREAS, the Zoning Board of Appeals has held a public hearing after due notice as required by law and has recommended that said special use permit be granted; and WHEREAS, the City Council has considered the recommendations of the Plan Commission and the Zoning Board of Appeals. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. The City Council hereby finds and determines that the proposed special use for a fire station and drill facility at the northeast corner of Big Timber Road and Morningside Drive in the City of Elgin, Illinois, is deemed necessary for the public convenience in providing a fire station for the north- west portion of the City; The City Council further finds that the proposed special use is so designed, located and proposed to be operated that the public health, safety and welfare will be protected in that the station will be located on the southwest corner of the property adjoining Big Timber Road and not adjacent to surrounding residential structures; The City Council further finds that the special use will not cause sub- stantial injury to the property or to the property in the neighborhood in which it is located. Section 2. That a special use is hereby granted to the City of Elgin to maintain a fire station and drill facility on the following described premises: The West fraction of the Southwest fractional quarter of Section 35, Township 42 North, Range 8 East of the Third Principal Meridian, lying Northerly of the Northerly line of Parcel No. N-4D-67.1 being an ease- ment acquired by the Illinois State Toll Highway Commissioner through proceedings filed in the Circuit Court of Kane County, Illinois, as Case No. 57-344, (except that part described as follows: Commencing at a point on the West line of said Section 35, 73.9 feet North of the Southwest corner thereof, said point being on the North line of a permanent road- way easement acquired by the Illinois State Toll Highway Commissioner '"' through proceedings filed in the Circuit Court of Kane County, Illinois, as Case No. 57-344; thence East along the North line of said permanent roadway easement, 932.65 feet for the point of beginning; thence North 15°00' East 239.0 feet; thence North 7°49' East 474.48 feet; thence North 6°52'20" west 641.35 feet; thence North 40°11' West 143.50 feet; thence North 5°18' west 197.00 feet; thence North 21°20'40" West 278.42 feet; thence North 11°20'44" West 278.42 feet; thence North 11°28'40" West 190.65 feet; thence North 78°31'20" East 164.0 feet to the Westerly bank of the Fox River; thence Southerly along the meandering Westerly bank of the Fox River, 2225 feet to a point of intersection with the North line of the aforesaid permanent roadway easement; thence West along said North line of said permanent roadway easement, 384.25 feet to the point of beginning) ; in the Township of Dundee, Kane County, Illinois. (Located east of and adjacent to the Elgin Airport north of the Illinois Toliway). Section 3. That all ordinances or part of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its passage in the manner provided by law and shall be published in pamphlet form by authority of the City Council. s/ Richard L.
