T5-75 Ordinance No. T5-75 AN ORDINANCE f PROVIDING FOR THE MAKING OF A LOCAL IMPROVEMENT IN AND FOR THE CITY OF ELGIN, KANE COUNTY, ILLINOIS BE IT ORDAINED by the Mayor and City Council of the City of Elgin, Kane County, Illinois: Section 1. That a local improvement shall be made in the City of Elgin, Kane County, Illinois, the nature, character, locality and description of which improvement is as follows: To the extent that standard specifications are available and appropriate, the Fountain Square Plaza Mall improvement shall be in full accordance with State of Illinois "Standard Specifications for Road and Bridge Construction" adopted July 2, 1973; "Standard Specifications for Traffic Signals" adopted March 1, 1968; The Manual of Uniform Traffic Control Devices for Streets and Highways, adopted in 1972; and all applicable National and Local Codes and Ordinances governing its construction. The mall improvement will be constructed completely within the rights-of-way of South Grave Avenue from Chicago Street to Prairie Street, DuPage Street from South Grove Avenue to Spring Street, and the two alleys connecting South Grove Avenue with eft Riverside Drive. Vehicular traffic, with the exception of emergency traffic such as fire, police and utility maintenance vehicles, will not be permitted within the rights-of-way of South Grove Avenue from Chicago to Spring/Fulton (with the exception of traffic to the Union Bank Drive-up window and the alley connecting Douglas and Spring) and DuPage Street from South Grove Avenue to Spring Street. Within these rights-of-ways, trees will be located in raised planters and flush areas utilizing tree grates to cover the pit area. These trees are to be in a staggered arrangement to allow for passage of the emergency vehicles. The proposed mall surfacing will consist of textured granite paver units exhibiting a range of color and tone to create a subtle variation and warmth to the basic floor scape. A full complement of architectural street features will be furnished as an integral part of the mall construction. They are such items as a centrum, an addition to and modification of the exist- ing fountain, raised planters, bollards, benches, flower pots, trash receptacles, service centers, clock, pedestrian lights and flag poles. South Grove Avenue, from Fulton Street to Prairie Street, will remain open to all vehicular traffic. The roadway pavement will narrowed to 40-42 feet. The additional width will be utilized to enlarge the existing sidewalk area. The alley north of the Joseph Spiess store shall be changed in grade slightly by use of concrete retaining wall and fill. elk The alley shall be filled with stone base material on which the pavers shall be placed. The alley north of the law offices and Daily Courier News office shall have a canopy supported by joists. Lighting shall utilize in- candescent lamps mounted in the roof system. Construction of the Fountain Square Plaza Mall improvement shall be governed by the following construction items: I. UNDERGROUND CONSTRUCTION A. REMOVALS AND ABANDONMENTS All of the existing roadway pavement, sidewalk and curb shall be removed on South Grove Avenue and DuPage Street. The curb, sidewalk and part of the existing pavement on South Grove Avenue, from Fulton Street to Prairie Street, will be removed. The existing pavement on South Grove Avenue will be sawed along and 20-22 feet either side of and parallel to the center line. All the existing parking meters and si gns shall be removed by the City of Elgin. The street lights, founda- tions, and underground cable or conduit will be removed. Should the property owner elect to abandon the existing basement areaway vault he shall at his own separate ex- pense relocate the existing utilities as given herein: Telephone, power service and junction boxes, heating, and cooling equipment. Water meters and gas equipment will be relocated at the expense of the City and Gas Company, respectively. The project will include the removal of the existing slab in such a manner to not damage or weaken the existing building structure and the removal of the existing curb line wall to a depth of at least two feet below the pro- posed grade. The property owner is responsible for the breaking up of any existing floors for drainage purposes and the construction of a property line wall consisting of reinforced block. The vault shall be backfilled with crushed stone or sand as part of the project. Lumber or trash is to be removed prior to the backfilling operation. When a basement areaway is to be retained, the existing roof structure may require removal. A new reinforced concrete waterproofed roof slab system will be constructed by the owner at the elevation necessary to accept the new paving system. E. DRAINAGE SYSTEM rft. The drainage system will consist of standard State of Illinois Type C catch basins which will tie into the proposed manholes by use of standard State of Illinois storm sewer lateral pipe. The existing combined storm and sanitary sewer will be maintained as the sanitary sewer. A new trunk storm sewer will be constructed utilizing standard reinforced concrete pipes and manholes. In addition, perforated corrigated metal pipe will be placed in the subgrade as a means of intercepting and disposing of any lateral migration of the water table. Catch basins will be provided at locations which will be predicated upon the final pavement elevations and will be provided with a standard cast iron frame on which perforated paver lids will be installed. II. SURFACE CONSTRUCTION A. BASE COURSE The base course for South Grove Avenue and DuPage Street e" will consist of a stone base of sufficient thickness to provide structural support for the passage of emergency vehicles. The base for the sidewalk treatment on South Grove Avenue will consist of concrete reinforced with wire mesh. B. PAVER SYSTEM The paving system is nominal 8" by 8" and 4" by 4" tex- tured paver units exhibiting a range of color and tone to create a subtle variation and warmth to the floor scape and range in nominal thickness from two inches to four inches. The pavers shall be placed on either the crushed stone base (for the stone base treatment) or on a mortar bed for the reinforced concrete treatment. The pavers shall be placed so that they align on a trans- verse joint and are staggered longitudinally. C. TERRAllO The sidewalk treatment along South Grove Avenue shall be placed in a thin layer after the concrete underlayment on which the terrazzo is placed has cured for a suitable period. An alternate system of exposed aggregate could be utilized. This system requires seeding the fresh concrete with small stones and partially washing the matrix to expose the stone. III. ELECTRICAL DISTRIBUTION SYSTEM AND LIGHTING rft An electrical distribution system shall be provided to supply power to the pedestrian lights, street lights, service outlets, planter and tree lights, service centers, centrum, clock and irrigation controller. A. POWER PANELS The distribution system shall receive power from panels consisting of a transformer of adequate size and rating, a main disconnect, and a metering facility. The power shall be obtained from the existing Commonwealth Edison Transformer vault located nearest to the intersection of DuPage Street and Grove Avenue. Separate distribution panels shall be provided for the pedestrian lights and street lights which shall be con- trolled by an astronomic time clock which shall energize power contractors. The panels for the service outlets shall be controlled by contractors, with auxiliary on-off switch, located in a service centrum. 00w. The panels shall be located in a reinforced concrete vault located below the centrum. Access to the electrical vault shall be provided through an access hatch in the centrum. B. CONDUIT AND CABLE SYSTEM -- The underground conduit shall be galvanized steel and shall be placed in a prepared trench with 24 inch minimum cover. The conduit and cable shall be of adequate size to provide for the power distribution service. C. LIGHTING The pedestrian lights to be provided within the right-of- way limits of South Grove Avenue and DuPage Street shall consist of incandescent lights mounted at a height of 12 feet. The pole shall be an aluminum or steel round pole with a hood of clear acrylic. The trees shall be illuminated by means of incandescent light bulbs placed in a well of the planters or on the pro- tective guards around the tree trunks. The streetscape lighting for South Grove Avenue shall be eft. accomplished by use of 400 watt deluxe white mercury vapor lights mounted at 32 feet on steel poles. So much of the aggregate amount of the assessment as represents the cost of levying, making and collecting the special assessment and all expenses r'' allowed by law, together with all fractional amounts so as to leave the remain- ing installments of the aggregate assessment equal in amount and each in multiples of $100.00 shall be apportionate to the first installment of the said special assessment. The first installment shall be due and payable on the 2nd day of January next after the filing of the first voucher issued on account of work done on the said improvement. The second installment of said assessment shall be due and payable one year thereafter, and so on annually until all assessments have been paid. IT IS HEREBY made the duty of the Board of Local Improvements of the CITY OF ELGIN, to file in the Office of the Clerk of the Court in which such assessment was confirmed, a certificate signed by the Secretary of the Board of Local Improvements of the CITY OF ELGIN of the date of the first voucher and the amount of the said voucher, within thirty (30) days after the issuance of the said voucher. All installments shall bear interest until paid at the rate of seven per cent (7%) per annum, being the rate now permitted by law. Interest on all installments shall begin to run in accordance with the pro- visions of the Illinois Municipal Code, Article 9, Division 2, and amendments thereto. Interest on such first installment shall be due and payable and shall be collected at the same time as the first installment. Interest on the second and succeeding installments shall be due and payable and shall be collected with the installments respectively as in said Code relating to special assessment provided. Section S. That for the purpose of anticipating the collection of the second and succeeding installments of said assessment for the cost of said improvements, the CITY OF ELGIN shall issue bonds payable out of said install- ments, bearing interest at the rate of seven per cent (7%) per annum, being the rate now permitted by law, signed by the Mayor of the City of Elgin, and attested to by the City Clerk of said City. Said bonds shall be issued in accordance with and shall in all respects conform to the provisions of the Illinois Municipal Code, Article 9, Division 2, and amendments thereto. Section 6. That the Mayor of the CITY OF ELGIN be and he is hereby directed to file a Petition in the Circuit Court of Kane County, Illinois, in the name of the people of the CITY OF ELGIN, praying that steps may be taken to levy a special assessment for the purpose of defraying the expense of said improvement so far as the same may lawfully be done and to ascertain what property will be benefited, in accordance with the provisions of this ordinance, and in the manner prescribed by law. Section 7. That all ordinances, or parts of ordinances, in conflict with this ordinance, be, and the same are hereby repealed. Section 8. That this ordinance shall be in full force and effect from and after its passage and approval thereof according to law. PASSED: This 19th day of February , 1975.
