G51-75 Ordinance No. G51-75 AN ORDINANCE AUTHORIZING THE ADVERTISEMENT FOR BIDS FOR THE LEASE OF SPACE IN THE ELGIN FOUNTAIN SQUARE PLAZA WHEREAS, the City of Elgin is causing a portion of Grove Avenue in the City of Elgin, Illinois, to be reconstructed as a pedestrian shopping mall; and WHEREAS, vehicular traffic will not be permitted in the principle area of said pedestrian shopping mall; and WHEREAS, a portion of Grove Avenue within said pedestrian shopping mall is no longer necessary for the exclusive use of the public; and WHEREAS, it is necessary and desirable to provide the service facility in the mall for use by pedestrians which is also suitable for commercial activities. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That public notice shall be given by the City Clerk by publication in the Daily Courier-News of notice of intent to lease certain property owned by the City of Elgin inviting bids thereon, all as provided below. Section 2. That the City Clerk shall cause the following notice to be published as provided in Section 1. "Notice of Lease of Property Owned by the City of Elgin and Invitation to Bid Thereon Please take notice that the City Council of the City of Elgin will receive sealed bids for the lease, under the successful bid, of the fee simple interest of 300 square feet of public property located at the end of the pedestrian walkway between Scotty's Shoe Store and the Joseph Spiess Company on Grove Avenue in the City of Elgin, Illinois, which property is currently devoted to use as a public street. Bids for the purchase of the aforesaid interest in the above described property are hereby invited and will be received by the City of Elgin, at 150 Dexter Court, Elgin, Illinois, between the hours of 8:00 a.m. and 5:00 p.m. until September 10, 1975. Said proposals shall be addressed to the City of Elgin, c/o Robert 0. Malm, Purchasing Agent, 150 Dexter Court, Elgin, Illinois, and shall bear the legion "Proposal-Lease of Mall Space" and the name and address of the bidder. All bids received will be publicly opened and read aloud at the regular meeting of the City Council of the City of Elgin at 7:30 p.m. on September 10, ePh 1975. The City of Elgin proposes to lease said property upon the following terms and conditions: Alo 1. The site is to be improved by the construction of a building approximately 15 feet by 20 feet designed to provide financial services to the general public. 2. The bid shall contain a set of plans in sufficient detail as to indicate floor lay-out, space utilization and interior appearance, including a landscape plan together with a work schedule for planned submission, construction, commence- ment, project completion and occupancy. 3. Said facility shall be designated to provide banking or other financial service facilities during normal hours of operation of the surrounding central business district, to accept utility payments, to provide information service to pedestrians for direction and location of stores and general information concerning the City of Elgin. Said facility shall include a space for a postal drop, graphic directory, public telephone and a drinking fountain. 4. The proposal shall include a commitment for lease of the subject property for a 20-year term with annual rent of not less than $1,200 per year. All costs of construction will be borne by the successful bidder. 5. Any lease for the subject property shall include a All provision requiring the lessee to pay an assessment for the construction of the pedestrian mall based on the same formula , used in assessing other properties in the mall area. 6. Any lease shall also include a provision that the lessee shall pay real estate taxes on the building to be erected which shall be taxed as a lease-hold estate on exempt land. 7. There shall be submitted with any proposal a certified check payable to the City of Elgin in the amount of $1,200 together with a completion bond or other security acceptable to the City to guarantee completion of the proposed development within a reason- able time. 8. City reserves the right to reject any and all bids and to accept any bid or waive any requirement thereof as the corporate authorities shall deem to be in the City's best interest. s/ Marie Yearman City Clerk Section 3.
