G49-75 Ordinance No. G43-75 AN ORDINANCE PROHIBITING SPRINKLING WHEREAS, from time to time the adequate supply of water necessary to promote and maintain the public health is threatened by the use of water for purposes not essential to the public health; and WHEREAS, such occasions are of a limited duration and temporary in nature; and WHEREAS, sprinkling of lawns is not essential to the public health and represents a substantial demand on the water supply of the City; and WHEREAS, on the aforesaid occasions it is necessary and desirable to curtail the use of water for sprinkling purposes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That it shall be unlawful for any person to use water supplied by the City of Elgin for the purpose of sprinkling of lawns when the Water Operations Director determines that such use threatens the capacity of the water system of the City of Elgin to serve the public health needs of the City. For the purpose of this section, "lawn, means that portion of any lot under e''' cultivation with grass, trees, shrubs, bushes, gardens or similar vegetation, other than vegetable gardens and newly seeded or sodded lawns within previous three weeks." Section 2. That it shall be the duty of the Water Operations Director to determine when the adequate supply of water for the public health purposes is threatened by the continued use of water for non-essential purposes. Upon making such determination the Water Operations Director shall cause a written memorandum to be submitted to the City Manager indicating that he has made a determination that the adequate supply of water for public health services is threatened. Said memorandum shall contain the director's findings of fact in support of his determination and shall request that the City Manager shall cause notice of such determinations to be given as is hereinafter provided. Section 3. Upon determination by the Water Operations Director that the adequate supply of water is threatened as provided in this ordinance, the City Manager shall cause notice to be given by press release to radio and newspaper. Section 4. That it shall be the further duty of the Water Operations Director to determine when an adequate water supply has been restored as to permit the use of water for non-essential purposes. Upon making such determina- tion the Water Operations Director shall submit a written memorandum to the City Manager advising him of such determination. Upon receipt of such memorandum, the City Manager shall give notice of such determination as provided /► above. Section 5. That it is urgent that this ordinance take full force and effect immediately upon its passage in order to insure an adequate water supply for public health purposes. Section 6.
