G42-75 Ordinance No. G42-75 AN ORDINANCE GRANTING A SPECIAL USE FOR A COMMUNITY SERVICE FACILITY AT 1640 MARK AVENUE WHEREAS, a written application has been made by the Association for Individual Development for a special use for the establishment and mainte- nance of a Community Service Facility at 1640 Mark Avenue, Elgin, Illinois, to permit the establishment, maintenance and operation of a residential home for the developmentally disabled; and WHEREAS, the Plan Commission has reviewed said application and made its findings and recommendations to the Zoning Board of Appeals and the City Council; and WHEREAS, a public hearing has been held by the Zoning Board of Appeals after due notice by publication as provided by statute; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the City Council; and WHEREAS, the City Council has reviewed the report and recommendations of the Plan Commission and the Zoning Board of Appeals. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF 01° ELGIN, ILLINOIS: Section to That the City Council finds that the application for a special use of the property hereinafter described is intended to provide a specialized program in a residential setting for the developmentally disabled in order to provide a means by which handicapped persons can reach their highest level of independent living; The City Council further finds that it is the public policy of the State of Illinois not to discriminate against the handicapped in their residential needs; The City Council further finds that no such community service facility exists in the City of Elgin and that such a facility is needed to provide a transitional return to society by the developmentally disabled, an alternative to placement in an institution, a residence for developmentally disabled persons lacking family support, and training for totally independent living by the developmentally disabled; The City Council further finds there is a need for such a community service facility in the City of Elgin and that the proposed special use is necessary for the public convenience at the location proposed which offers a multi-family residential setting suitable for the residential nature of the special use; The City Council further finds that the proposed use is subject to licensing and regulation by the Department of Public Health, State of Illinois, which is vested with licensing authority and which has promulgated minimum standards, rules and regulations for the operation of community living facilities; Presented: July 9, 1975 Passed: July 9, 1975 Vote: Yeas 6 Nays 0 Recorded: July 9, 1975 Published: July 9, 1975 Attest: s/ Diane L.
