G1-75 Ordinance No. G1-75 AN GRANTING A PECIALNUSEEPERMIT FOR A MENTAL HEALTH CLINIC AND RELATED USES WHEREAS, the Fox Valley Mental Health Association, Inc. has filed its written petition for a special use permit to permit the operation of a mental health clinic and related activities at 396 Division Street, Elgin, Illinois; and WHEREAS, the Plan Commission has submitted its report to the Zoning Board of Appeals and the City Council; and WHEREAS, the Zoning Board of Appeals conducted a public hearing after due notice and has reported its findings and recommendations to the City Council; and WHEREAS, the Plan Commission and the Zoning Board of Appeals have recommended approval. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That it hereby finds and declares that the proposed special use for a mental health clinic and related uses is necessary for the public convenience in providing the community with a necessary service not other- wise available; The City Council further finds and declares that the proposed use is so designed, located and proposed to be operated that the public health, safety and welfare will be protected in that adequate staff and supervision will be provided; The City Council further finds and declares that the proposed special use will not cause substantial injury to the value of other property in the neighborhood in which it is located in that the proposed use is not anticipated to increase traffic and hours of operation will be limited. Section 2. That a special use is hereby granted to the Fox Valley Mental Health Association, Inc. for the operation of a mental health clinic including related uses at the premises located at 396 Division Street, Elgin, Illinois and legally described as follows: Lot 4 (except the North 75 feet) in Gail Borden's Sub- division of County Clerk's Subdivision of Lots CCXCIX and CCXCVIII; in the City of Elgin, Kane County, Illinois. Section 3. That the special use herein granted shall be limited to the Pox Valley Mental Health Association, Inc. and shall be subject to the provi- sion of required off-street parking on the subject premises or upon premises immediately adjoining the subject premises. r Section 4.
