Ordinance No. T1-74
r AN ORDINANCE
ESTABLISHING FEES FOR THE CONNECTION AND USE OF CERTAIN WATER
MAIN IMPROVEMENTS.
WHEREAS, the City of Elgin has caused certain water main improvements to
be made and identified as Riverside Manor - Fox River water main improvements;
and
WHEREAS, the City of Elgin has contracted for the installation of the
following improvements:
A connected system of cast iron water mains of sizes varying from six
inches (6") to eight inches (8") herein provided for and described as
Riverside Manor - Fox River Water Main Improvements, Elgin, Kane County,
Illinois, complete with gate valves, vaults, hydrants and all cast iron
fittings shall be constructed within public streets, all described as
follows:
An eight inch (8") water main, from and connected with an existing
twelve inch (12") water main, at a point approximately thirty feet (30')
northeast of the intersection of the centerlines of Ranch Road and West
River Road.
Thence northeasterly for a distance of four hundred and sixty feet
ck (460') parallel with the centerline of West River Road at a distance of
seven feet (7') southeast of the southeasterly pavement edge of West River
Road (as measured perpendicular from the southeasterly edge of the existing
pavement on West River Road) to a point approximately twenty feet (20')
southeast of the intersections of the centerlines of West River Road and
Leslie Street.
Also, a six inch (6") water main from and connected with an eight
inch (8") water main herein before provided for at the above mentioned
point, easterly for a distance of four hundred and seventy feet (470')
parallel with the centerline of Leslie Street at a distance of seven
feet (7') south of the existing south pavement edge of Leslie Street
connected to an existing six inch (6") water main that traverses in a
southerly direction.
Also, a six inch (6") water main from and connected with an existing
twelve inch (12") water main approximately forty five feet (45') southeast
of the intersection of the centerlines of Ranch Road and Tyler Lane south-
erly and southeasterly for a distance of one thousand and eighty five feet
(1085') parallel to the centerline of Tyler Lane and :Hazel Drive at a
distance of seven feet (7') east of the easterly pavement edge of Tyler
Lane and seven feet (7') north of the northerly pavement edge of Hazel
Drive connected to an existing six inch (6") water main approximately
three hundred and twenty five feet (3259. southwest fromi the intersection
of the centerlines of Hazel Drive and Wauchope Drive.
Also, a six inch (6") water main, from and connected with an existing
six inch (6") water main at a point approximately one hundred and seventy
k feet (170') south of the centerline of U.S. 20 B.T. .(Larkin Avenue) and
approximately seven feet (7') west of the centerline' of Second Street south-
westerly for a distance of one hundred feet (100') to a point seventeen feet
(17') west of the centerline of Second Street.

Thence, from the above mentioned point southerly for a distance of
two thousand and fifty feet (2050') parallel with the centerline of Second
Street at a distance of seven feet (7') west of the westerly pavement edge
of Second Street to a point near the northerly right-of-way line of U.S.
Route 20 (Elgin Bypass).
Also, an eight inch (8") water main from and connected with an
existing eight inch (8") water main, at a point approximately seventy
feet (70') southwest of the intersection of the centerlines of Larkin
Avenue (U.S. 20 Is.R.) and Airlite Street southerly for a distance of
ninety feet (90') parallel with the centerline of Airlite Street at a
distance of seven feet (7') west of the west pavement edge of Airlite
Street to a point.
Also, a six inch (6") water main connected with an eight inch (8")
water main herein before provided for at the above mentioned point,
southerly parallel with the centerline of Airlite Street at a distance
of seven feet (7') west of the westerly pavement edge of Airlite Street
for a distance of eight hundred and sixty feet (860') to a point near
the northerly right-of-way line of U.S. Route 20 (Elgin Bypass) .
Also, an eight inch (8") water main, from and connected with an
existing twelve inch (12") water main at a point approximately fifty
five feet (55') northeast of the intersection of the centerlines of
Larkin Avenue (U.S. 20 B.R.) and Lyle Street, southerly for a distance
of two thousand six hundred and thirty feet (2630') parallel with the
centerline of Lyle Street at a distance of seven feet (7') east of the 41/ 4
easterly pavement edge of Lyle Street to a point near the northerly
right-of-way line of U.S. Route 20 (Elgin Bypass) .
Also, an eight inch (8") water main connected with an eight inch
(8") water main herein before provided for a point approximately twenty
five feet (25') northeast of the intersection of the centerlines of
Lyle Street and Erie Street, westerly for a distance of five hundred and
five feet (505') parallel with the centerline of Erie Street at a distance
of seven feet (7') north of the northerly pavement edge of Erie Street to
a point approximately seventy five feet (75') west of the centerline
of Second Street and seventeen feet (17') north of the centerline of Erie
Street.
and
WHEREAS, the cost of said improvements to the City of Elgin is approximately
$83,344; and
WHEREAS, said improvements extend across property located within the City
of Elgin for a distance of 10,296,38 lineal feet; and
WHEREAS, the City of Elgin is a home rule unit empowered to exercise any
power or perform any function pertaining to its government and affairs; and
WHEREAS, it is reasonable to require owners of property adjoining said
improvement to bear a proportionate share of the cost of said improvement in
the event that said owners desire to connect to and use said water mains.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS.

Section 1. That any owner of property adjoining the above described
Riverside Manor- Fox River Water Main Improvement who desires to connect to
and use said facilities shall pay to the City Treasurer of the City of Elgin,
Illinois, a fee in an amount determined at the rate of $8.00 per front foot
of such owner's property adjoining said improvement. Said fee shall be in
addition to any and all other fees established by the City of Elgin for water
service.
Section 2. That in accordance with the provisions of Section 1 of this
ordinance the following amounts are established to be paid for connection to
property adjoining the Riverside Manor - Fox River Water Main Improvement.

Section 3. That adjoining properties held in common ownership shall be
subject to payment of an amount based upon the frontage of all said properties
when application for connection for any of said lots is made.
Section 4. That any person desiring to hook on to said water main improve-
ment prior to July 1, 1974 may pay said amount in full without interest.
Section 5. That any person desiring to hook on to said water main improve-
ment after July 1, 1974 shall pay an amount equal to not less than 20% of the
amount established for the property to be served plus interest at the rate of
7% of the total amount due accruing from and after July 1, 1974 to the date of
payment.
Section 6. That after connection and partial payment as provided in this
ordinance an additional 20% of the total amount due plus interest at the rate of 7%
of the total balance due since the last payment shall be made on January 1 of each
succeeding year until the total amount is paid.
Section 7. That a certified copy of this ordinance shall be recorded with
the Recorder of Deeds of Kane County, Illinois.
Section 8. That all ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 9. That this ordinance shall be in full force and effect from and
after its passage and approval in the manner provided by law and shall be
published in pamphlet form by authority of the City Council.
