AN ORDINANCE
AMENDING ORDINANCE G12-74 AUTHORIZING THE SALE OF BEER
AT SPARTAN MEADOWS GOLF COURSE
WHEREAS, the City of Elgin has duly enacted Ordinance G12-74 authorizing
the sale of beer at the Spartan Meadows Golf Course; and
WHEREAS, the City of Elgin is a home rule unit authorized to exercise
any power and perform any function relating to its government and affairs.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS:
Section 1. That Section 1 of Ordinance No. G12-74 authorizing the sale
of beer at the Spartan Meadows Golf Course is hereby amended by adding the
following:
"That in the exercise of its home rule powers the City of
Elgin hereby declares that the provisions of Chapter 43 of the
Illinois Revised Statutes, 1973, insofar as said provisions may
require a retail alcoholic liquor dealers license for the sale
of beer at the Spartan Meadows Golf Course by the City of Elgin,
its agents and employees, be and are hereby declared to be of no
force and effect.
That in the exercise of its home rule powers the City of
Elgin further declares that any provisions of Chapter 43 of the
Illinois Revised Statutes, 1973 limiting or restricting the sale
at retail of beer at municipally owned golf courses as provided
in Section 130 of said Chapter, be and are hereby declared to be of
no force and effect."
Section 2. That Section 3 of Ordinance No. G12-74 authorizing the sale
of beer at the Spartan Meadows Golf Course, be and is amended by adding the
following:
"For the purposes of this ordinance, the food service require-
ments of this section may include but are not limited to the follow-
ing: taco chips, corn chips, potato chips, pop corn, pretzels,
cocktail sandwiches, luncheon sandwiches."
Section 3. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law.
