AN ORDINANCE AMENDING THE ELGIN ZONING ORDINANCE RECLASSIFYING CERTAIN PROPERTY ADJACENT TO THE VILLA OLIVIA GOLF CLUB AND GRANTING A SPECIAL USE FORA PLANNED UNIT DEVELOPMENT WHEREAS, written application has been made to reclassify certain property adjacent to the Villa Olivia Golf Club from M-1, Manufacturing, to B-3, Service Business District, and for a special use for a planned unit development; and WHEREAS, the Plan Commission has reviewed said application and submitted its report to the Zoning Board of Appeals and to the City Council; and WHEREAS, the Zoning Board of Appeals has conducted a public hearing after due notice and submitted its report and recommendations to the City Council; and WHEREAS, the City Council has reviewed the findings and recommendations of the Plan Commission and the Zoning Board of Appeals. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Subsection B of Section 21-106 of Chapter 21 of the City Code of Elgin, Illinois, as amended, be and the same is hereby further amended by adding thereto the following paragraph: The boundaries herein- before laid out in the "Zoning District Map", as amended, be and are hereby altered by excluding from M-1, Manufacturing and including in B-3, Business Service District, the following described property: That part of the North East quarter of Section 29, Township 41 North, Range 9 East of the Third Principal Meridian, described as follows: Commencing at a point in the center line of Illinois High- way Route No. 5, 554.4 feet South and North 84 degrees, 30 minutes, West 657.36 feet from the North East Corner of said Section 29; thence Southerly, a distance of 2173.38 feet to a point in the South line of said North East quarter that is 655.38 feet East of the South West corner of said East half of the North East quarter, thence Westerly along the South line of said North East quarter, a distance of 762.8 feet to a point 1214.0 feet East of the South West corner of said North East quarter; thence North Westerly in a straight line 1590.0 feet to a point 1033.0 feet East of the West line of the West half of the said North East quarter; thence East parallel with the South line of said North East quarter, a distance of 360.94 feet; thence Northerly along a line that forms an angle of 88 degrees 21 minutes 17 seconds to the left with the prolongation of the last described course, a distance of 829.49 feet; thence Easterly along a line that forms an angle of 39 degrees 34 minutes 17 seconds to the right with the prolongation of the last described course, a distance of 9.83 feet to the center line of Old Illinois Highway Route No. 5; thence South Easterly along said center line, a dis- tance of 600.40 feet to the place of beginning, being situated in the City of Elgin, Hanover Township, Cook County, Illinois. (Located east of 1601 Villa Street.) Section 2. That a special use for a planned unit development on property described in Section 1 be and is hereby granted subject to the following: 1. Any required widening and signalization of highways required by the City of Elgin and the Illinois Department of Transportation shall be the responsibility of the developer; unless funds are otherwise available; however no portion or costs of said improvements shall be borne by the City of Elgin. 2. That the major collector street off of Route 20 shall be widened and developed as a boulevard-type street as directed by the City of Elgin in order to provide separation between the golf course and townhouses on the east and the commercial development on the west; such street shall be designed so as to be wide enough to handle traffic generated by the development. 3. The commercial area located west of the proposed collector street shall be developed only as (a) a unified neighborhood shopping center specifically approved by the City of Elgin and of approximately 150,000 square feet in floor area and exceeding 175,000 square feet; and (b) a recreation/sports complex. The free-standing commercial structures shown on the preliminary site plan shall be eliminated; but in the discretion of the City Council free-standing structures may be permitted on the final site plan if they are physically and architecturally consistent with the archi- tectural style of the main shopping center so that they enhance rather than detract from the aesthetic appearance of the entire shopping center. 4. That no residential units shall be constructed within 250 feet of U.S. Route 20 and eight units proposed to be located at the south end of the row of townhouses that open directly onto the collector street be eliminated. 5. That all plans for signs and landscaping shall be sub- mitted to the Department of Community Development of the City of Elgin for approval in accordance with applicable ordinances of the City of Elgin. 6. That the main collector street proposed off of Route 20 shall remain a private street. 7. That developer shall participate in a special assessment to be initiated by City to provide a local improvement consisting of a looped water distribution system to serve subject property and to be commenced concurrently with the planned unit development. 8. That the final site plan shall be submitted for approval and shall be in accordance with the ordinance and all other ordinances of the City of Elgin. 9. That construction shall commence within five years of the effective date of this ordinance and it shall be completed no later than ten years after the effective date of this ordinance. Any extension of said time limit shall be within the sole discre- tion of the City of Elgin and shall not be granted unless work is shown to be progressing satisfactorily. 10. The final plat and site plan shall provide no less than three acres for use by occupants of residential structures tow without charge as recreational areas; 20,000 square feet of said recreational areas shall be devoted to use as tot lots. Section 3. That the City Council of the City of Elgin hereby finds that the special use for a planned unit development granted herein is deemed neces- sary for the public convenience in providing shopping and recreational facili- ties for residential development of the property adjacent to the subject property located within the Village of Bartlett and to serve the needs of the residents of the City of Elgin. The City Council further finds that the special use granted is so designed, located and proposed to be operated that the public health, safety and welfare will be protected and promoted by the conditions imposed by this ordinance. The City Council further finds that substantial injury will not result to the value of other property in which the subject property is located as the special use granted herein is an integral part of the development of the surrounding area. Section 4. That this ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law and shall be published in pamphlet form by order of the City Council. s/ W.
