T-1360Ordinance No. T -1360 AN ORDINANCE t PROVIDING FOR THE MAKING OF A LOCAL IMPROVEMENT IN AND FOR THE j CITY OF ELGIN, KANE COUNTY, ILLINOIS. BE IT ORDAINED by the Mayor and City Council of the City of Elgin, Kane County, Illinois: Section 1. That a local improvement shall be made in the City of Elgin, Kane County, Illinois, the nature, character, locality and description of which improve - iprove- �$ent is as follows: 1e The said water mains shall be: A connected system of Cast Iron water mains of sizes varying from six inches (611) to twelve inches (12 ") herein provided for and described as Century Oaks Water Main Extension, Kane County, Elgin, Illinois, com- plete with gate valves, vaults, hydrants and all Cast Iron fittings shall be constructed within Public Streets, all described as follows: An Eight Inch (811) water main, from and connected with an existing Twelve Inch (12 ") water main, at a point approximately Forty Feet (401) East of the centerline of SLEEPY HOLLOW ROAD and Five Feet (51) North of the northerly edge of existing pavement on FOREST DRIVE (as measured perpendicularly from the North edge of the existing pavement on FOREST DRIVE); Thence, Easterly for a distance of Two Thousand Eight Hundred and Seventy Five Feet (28751) parallel with the said Northerly edge of FOREST DRIVE at a distance of Five Feet (51) from the edge of pavement to a point Fifteen Feet (151) East of the centerline of PLEASANT DRIVE and Fifteen Feet (151) North of the centerline of FOREST DRIVE; Also, a Six Inch (6 ") water main from a point Fifteen Feet (15') from the centerline of PLEASANT DRIVE and Fifteen Feet (151) North of the center- line of FOREST DRIVE, Easterly and Southeasterly for a distance of One Thousand Seven Hundred and Ten Feet (17101) parallel with the Northerly and Easterly edge of pavement of FOREST DRIVE at a distance of Five Feet (51) except at deflections in the centerline of pavement and at the Southerly end of this section of the water main at which locations the distance of the water main from the edge of the pavement shall be variable. Also, a Six Inch (611) water main from and connected with a water main hereinbefore provided for at a point Fifteen Feet (151) East of the center- line of PLEASANT VIEW on FOREST DRIVE, Southerly for a distance of Three Hundred and Twenty Feet (3201) parallel with the Easterly pavement edge of PLEASANT VIEW at a distance of Five Feet (5') from the Easterly edge of PLEASANT VIEW except at the Southerly end of this section of the water main at which location the distance from the edge of the pavement shall be variable. Also, a Six Inch (6 ") water main from and connected with a water main hereinbefore provided for at a point Fifteen Feet (15') East of the inter- section of FOREST DRIVE with FOREST DRIVE, Southerly parallel with the centerline of FOREST DRIVE at a distance of Five Feet (51) from the East pavement edge of ROBINWOOD DRIVE for a distance of Four Hundred and Forty Feet (4401) to and connecting with an existing Six Inch (611) water main. Also, a Six Inch (611) water main from and connected with a water main hereinbefore provided for at a point Fifteen Feet (151) East of the intersection of the centerlines of PARKVIEW DRIVE and FOREST DRIVE, Southerly and Southeasterly for a distance of One Thousand One Hundred and Five Feet (11051) to and connect- ing with a proposed water main Northeast of the intersection of CENTURY OAKS DRIVE with PLEASANT DRIVE at a distance of Five Feet (51) East of the Easterly edge of PARKVIEW DRIVE except in the vicinity of PLEASANT DRIVE at which location the distance of the water main from the Easterly edge of PARKVIEW DRIVE shall be variable. Also, an Eight Inch (811) water main from and connected with a water main hereinbefore provided for at a point Northeast of the intersection of PARKVIEW DRIVE with PLEASANT DRIVE, South- easterly and Southerly for a distance of One Thousand Three Hund. and Eighty Eight Feet (1388') to and connecting with a proposed water main immediately South of HILLCREST ROAD, at a distance of Five Feet (51) East of the Easterly pavement edge of PARKVIEW DRIVE except in the vicinity of PLEASANT DRIVE at which location the distance of the water main from the pavement edge shall be variable. Also, an Eight Inch (811) water main, from and connected with a water main hereinbefore provided for at a point Fifteen Feet (151) East of the intersection of the centerlines of PLEASANT DRIVE and FOREST DRIVE, Southerly parallel to the centerline of PLEASANT DRIVE at a distance of Five Feet (51) East of the Easterly pavement edge of PLEASANT DRIVE for a distance of Nine Hundred Feet (9001) to and connecting with a proposed water main Northeast of the intersection of PLEASANT DRIVE with PARKVIEW DRIVE. Also, a Six Inch (61) water main, from and connecting with a water main hereinbefore provided for at a point Southeast of the intersection of the centerlines of GREEN ACRES LANE and PLEASANT DRIVE, Southeasterly for a distance of Six Hundred and Five Feet (6051) parallel to the centerline of GREEN ACRES LANE, Five Feet (51) West of the West pavement edge of GREEN ACRES LANE, except at the South end of this section of the water main at which loca- tion the distance from the pavement edge shall be variable. Also, a Six Inch (6 ") water main from and connecting with a water main hereinbefore provided for at a point Fifteen Feet (15') East of the intersection of the centerlines of OAKDALE DRIVE and FOREST DRIVE, Southerly and Southeasterly, Southerly and Westerly along OAKDALE DRIVE and CRESTVIEW LANE for a distance of Two Thousand Six Hundred and Five Feet (26051) to and connecting with a proposed water main Southeast of the intersection of the center- lines of CRESTVIEW LANE and PARKVIEW DRIVE, at a distance of Five Feet (5') from the Easterly and Southerly pavement edge of OAKDALE DRIVE and Southerly pavement edge of CRESTVIEW LANE except at deflections in the centerline of the pavement at which locations the distance of the water main from the pave- ment edge shall be variable. Also, a Twelve Inch (12 ") water main from and connecting with an existing water main at a point East of the intersection of FAIRWOOD DRIVE and LOGAN LANE Easterly for a distance of Two Hundred and Eighty Five Feet (2851) to a proposed water main Northeast of the intersection of the centerlines of LOGAN LANE and HILLCREST ROAD, parallel to centerline of LOGAN LANE, near the North pavement edge of LOGAN LANE. Also, an Eight Inch (8 ") water main from a point approxi- mately One Hundred and Twenty Five Feet (1251) North of the intersection of BIG TIMBER ROAD and HILLCREST ROAD, Northerly and Northeasterly, for a distance of Six Hundred and Fifty Feet (650') to and connecting with a proposed water main Northeast of the intersection of the centerlines of HILLCREST ROAD and PARKVIEW DRIVE, parallel to the center line of HILLCREST ROAD at a distance of Five Feet (51) East of the Easterly pavement edge of HILLCREST DRIVE except in the vicinity of LOGAN LANE at which location the distance of the water main from the pavement edge shall be variable. Also, a Six Inch (611) water main from and connected with a water main hereinbefore provided for at a point Northeast of the intersection of the centerlines of HILLCREST ROAD and PARK - VIEW DRIVE, Easterly, Northerly and Westerly along HILLCREST ROAD and MEADOW LANE for a distance of Two Thousand Eight Hundred and Ten Feet (28101) to and connecting with an existing water main approximately Four Hundred Feet (4001) West of the intersection of MEADOW LANE and PARKVIEW DRIVE, parallel to the centerline of HILLCREST ROAD and MEADOW LANE, Five Feet (51) South and East of the South and East pavement edge of HILLCREST ROAD and Five Feet (51) North of the North pavement edge of MEADOW LANE, except at deflections in the centerline of the pavement at which locations the distance of the water main from the pavement edge shall be variable. Also, an Eight Inch (811) water main from and connected with a proposed water main Northeast of the intersection of BIG TIMBER ROAD and NORNINGSIDE DRIVE, Northerly and Northeasterly along IRNINGSIDE DRIVE and Twenty Feet easement for a distance of One Thousand Six Hundred and Thirty Feet (16301) to and connected with an existing water main, parallel to the centerline of MORNINGSIDE DRIVE, Five Feet (51) East of the East pavement edge of MORNINGSIDE DRIVE except at the curvature in the centerline of pavement at which location the distance of the water main from the pavement edge shall be variable. Also, a Ten Inch (1011) water main from and connected to an existing water main approximately Five Hundred and Ninety Feet (5901) East of the intersection of MDRNINGSIDE DRIVE and BIG TIMBER ROAD, Westerly for a distance of.One Thousand Three Hundred and Forty Five Feet (13451) along BIG TIMBER ROAD, North of the North pavement edge, the distance between the pavement edge and the Section 2. That said improvement shall be made and the whole cost there. what p of, together with an amount not exceeding six per cent (6 %) of the estimated I ordina cost, to -wit: TWO HUNDRED FIFTY ONE THOUSAND DOLLARS ($251,000.00), which is hereby provided for to apply towards the cost and expense of making, S levying and collecting said special assessment and all other expenses allowed with t by law, being the amount included in the estimate thereof, shall be paid by special assessment, in accordance with the Illinois Municipal Code, Articleg S Division 2, and amendments thereto. I and of Section 4. That the aggregate amount herein ordered to be assessed against the property and against the municipality, if any, and also the assessment on each lot and parcel of land herein assessed shall be divided as follows: The said assessment to pay the cost of construction of said improvement and the cost of-levying, making and collecting said assessment and all expenses allowed by law, shall be divided into ten (10) installments, in the manner provided by the statute in such case made and provided. So much of the aggregate amount of the assessment as represents the cost of levying, making and collecting the special assessment and all expenses allowed by law, together with all fractional amounts so as to leave ATTEST the remaining installments of the aggregate assessment equal in amount and MY OFF each in multiples of $100.00 shall be apportionate to the first installment day of of the said special assessment. The first installment shall be due and pay- able on the 2nd day of January next after the filing of the first voucher issued on account of work done on the said improvement. The second install- ment of said assessment shall be due and payable one year thereafter, and s/ Mar so on annually until all assessments have been paid. IT IS HEREBY made the duty of the Board of Local Improvements of the CITY OF ELGIN, to file in the Office of the Clerk of the Court in which such assessment was confirmed, a certificate signed by the Secretary of the Board of Local Improvements of the CITY OF ELGIN of the date of the first voucher and the amount of the said voucher, within thirty (30) days after the issuance of the said voucher. All installments shall bear interest until paid at the rate of seven per cent (7%) per annum, being the rate now permitted by law. Interest on all installments shall begin to run in accordance with the pro- visions of the Illinois Municipal Code, Article 9, Division 2, and amendments thereto. Interest on such first installment shall be due and payable and shall be collected at the same time as the first installment. Interest on the second and succeeding installments shall be due and payable and shall be collected with the installments respectively as in said Code relating to special assessment provided. Section 5. That for the purpose of anticipating the collection of the second and succeeding installments of said assessment for the cost of said improvements, the CITY OF ELGIN shall issue bonds payable out of said install- ments, bearing interest at the rate of seven per cent (7 %) per annum, being the rate now permitted by law, signed by the Mayor of the CITY OF ELGIN, and attested to by the City Clerk of said City. Said bonds shall be issued in accordance with and shall in all respects conform to the provisions of the Ill Municipal Code, Article 9, Division 2, and amendments thereto. cemenle Section 6.
