AN ORDINANCE
AMENDING THE ELGIN CITY CODE TO PROHIBIT THE MODIFICATION OF MUFFLERS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:
Section 1. That Section 17-607 of Article XVI of Chapter 17 of
the Elgin City Code, as amended, is hereby amended to read as follows:
"17-607. Muffler Requirements.
A. Every motor vehicle driven or operated on streets
or highways of the City shall at all times be equipped with
an adequate muffler or exhaust system in constant operation
and properly maintained to prevent any excessive or unusual
noise. No muffler system shall be equipped with cutout,
bypass or similar device. No person shall modify the exhaust
system of a motor vehicle which will amplify or increase the
noise of the above that emitted by the muffler originally
installed on the vehicle and such original muffler shall
comply with all requirements of this section.
B. As used in this section, 'muffler' means a device
consisting of a series of chambers, baffle plates or other
mechanical design for the purpose of receiving exhaust gas
from an internal combustion engine and effective in reducing
noise."
Section 2. That all ordinances or parts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
Section 3. That this ordinance shall be in full force and effect from
and after its passage in the manner provided by law and shall be published
in pamphlet form by order of the City Council.
