G-1619 Ordinance No. G-1619 AN ORDINANCE ESTABLISHING A PERMIT PROCEDURE FOR OPEN AIR MEETINGS IN PUBLIC PARKS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Chapter 11 of the City Code of the City of Elgin, Illinois, as amended, is hereby further amended by deleting therefrom Subsection 11-5(1) and redesignating the following subsections (m) , (n) , (o) , (p) and (q) as (1) , On) , (n) , (o) and (p) respectively. Section 2. That there is hereby added to Chapter 11 of the City Code of the City of Elgin, Illinois, as amended, the following section: "11-6. Open Air Meetings. a. For the purpose of this section, open air meeting is defined as any congregation of citizens held in any public park for the purpose of hearing speakers or discussing some matter of common interest when the number of participants expected may reasonably be anticipated to exceed 25. b. No person, organization or group shall conduct an open air meeting in any public park unless a written permit therefor has been obtained from the Director of Parks: and Recreation. c. Applications to conduct an open air meeting in any public park shall be made in writing to the Director of Parks and Recreation at least 30 days prior to the event and by a representative of the person, group or organization seeking the permit and shall set forth the following information on forms as provided by the Director of Parks and Recreation. 1. The name, address and telephone number of the person making application to conduct an open air meeting; 2. The date the open air meeting is to be conducted; 3. The approximate number of persons anticipated to be in attendance; 4. The purpose of the meeting; 5. The location sought; 6. Equipment and materials to be used including._platforms, loud speakers, etc. d. Application shall be made by a resident of the City of Elgin or a local organization or group. e. Open air meetings shall be limited to the normal hours of operation of the parks and shall not be permitted to exceed three hours in duration. f. Open air meetings shall be permitted only at the Wing Park Bandshell, Lord's Park Pavillion or such other suitable and available place as the Director of Parks and Recreation may determine. g. Any person, organization or group seeking to conduct an open air meeting may be required to provide necessary off-duty City of Elgin policemen and bear the expense of same as part of the conditions of the permit sought if the Director of Parks and Recreation shall determine that the size, scope and nature of the meeting indicate the necessity for providing for the maintenance of order and safety. h. Application for an open air meeting shall be accompanied by a cash bond in the amount of $50 to insure that the area used is cleaned up following the meeting. The responsibility of cleaning up the area shall be borne by the permittee and upon satisfactory completion of the clean up, the cash bond shall be returned to the permittee. i. The permittee may be required to procure public liability insurance and property damage insurance in such All amount- as deLeiniined by the Director of Parks and Recreation if he shall determine that the meeting may result in liability of the City of Elgin; if required a certificate of insurance naming the-City of Elgin as an additional insured shall be filed prior to the day of the event. j . The cost of service performed by employees of the City- of Elgin shall .be borne by the permittee. k. No permit shall be issued after application for a permit indicates on its face that any act shall be allowed or suffered that is a violation of law. 1. Any permit granted for an open air meeting shall be conditioned upon compliance with the general regulations applicable .to the parks. m. The Director of Parks. ,and Recreation shall issue a permit upon. receipt of. an application in accordance with the conditions.of this section and when the requested date does not conflict with a permit already granted or other reservation .or planned activity for the site sought by the applicant. " Section 3. That all ordinances or parts of,ordinances in conflict with the provisions of this ordinance .are.hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after-its passage in the manner provided by law and shall be published in pamphlet form by order of the City Council.
