G-1592 • • Ordinance No. G-1592 AN ORDINANCE PROHIBITING PEDDLING FROM VEHICLES, WHEREAS the peddling of merchandise including but not limited to candy, ice cream, confections, food and beverages from vehicles upon or along the streets, highways and public places of the City of Elgin tends to create traffic congestion, entice and induce pedestrians, including children, to enter and remain upon the public streets, increasing the danger of personal injury to pedestrians, particularly children, and otherwise constitutes a nuisance; and WHEREAS the corporate authorities of any municipality may prohibit peddlers in accordance with Section 11-42-5 of Chapter 24 of the Illinois Revised Statutes, 1971; and WHEREAS the corporate authorities of any municipality may regulate the.•use of the streets and other municipal property in accordance with Section 11-80-2 of Chapter 24 of the Illinois Revised Statutes, 1971; and WHEREAS the City of Elgin, under the Constitution of 1970, is a home rule unit entitled to exercise any power and perform any function pertaining to its government and affairs including, but not limited to, the power to regulate for the protection of the public health, safety, morals and welfare. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the following section is hereby added to Article VI of the City Code of Elgin, Illinois: "27.605. Peddling Prohibited. It shall be unlawful to sell, barter; or exchange or offer for sale, barter or exchange any tangible personal property upon or along the streets, high- ways or public places of the City of Elgin or from house to house whether at one place thereon or from place to place, from any motor vehicle, wagon, truck, push cart or other vehicle or from moveable receptacles of any kind. This prohibition shall not include the delivery of any item previously ordered or the sale of items along delivery routes where the purchaser has previously requested the seller to stop and exhibit his items. Nor shall this prohibition include the solicitation of orders by sample where the goods are not delivered at the time the order is taken. Any person, firm or corporation who shall violate the provisions of this section shall be fined not less than $25 nor more than $500 for each offense; each day the offense continues shall constitute a separate offense." Section 2. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. • Section 3. This ordinance shall be in full force and effect ten days after its passage, approval and publication in pamphlet form. • .- 4 4 . . n. .
