AN ORDINANCE
AUTHORIZING A SPECIAL USE FOR THE CONSTRUCTION AND OPERATION
OF A MICROWAVE TOWER TO BE ESTABLISHED ON CERTAIN PROPERTY,
PURSUANT TO THE PROVISIONS OF CHAPTER 21 OF THE CITY CODE OF
ELGIN, ILLINOIS , ENTITLED "THE ELGIN ZONING ORDINANCE. "
WHEREAS, the City Council has been requested to autho-
rize a special use for the erection and operation of a micro-
wave relay tower upon said property hereinafter described,
in the City of Elgin, Illinois , and
WHEREAS, a written report has been prepared and forwarded
to the Zoning Board of Appeals and the City Council by the
Plan Commission pertaining to this particular petition, and
WHEREAS, a public hearing has been held by the Zoning
Board of Appeals , after due notice by publication, as pro-
vided by Statute, and its findings and recommendations have
been reported to the City Council, and
WHEREAS, the City Council has determined that such
Special Use requested is necessary for the public convenience,
can be designed, located and operated so that the public
health, safety and welfare will be protected, and will not
cause substantial injury to the value of other property in
the neighborhood in which it is located, and therefore,
should be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ELGIN, ILLINOIS :
Section 1. That a Special Use for the erection and
operation of a microwave relay tower be, and the same
hereby is authorized, pursuant to the provisions of Chapter
21 of the City Code of Elgin, Illinois, entitled "The Elgin
Zoning Ordinance, " on the real estate hereinafter described,
to-wit:
All of Lots 17 , 18, and 16, except 100 feet out of
the Northeast corner of Lot 16, in Block 11, Eastview
Addition to the City of Elgin, Kane County, Illinois ,
being the same land conveyed to Abraham Kershaw from
Frieda Hansen Uteg and recorded in Book 2514, Page 524,
Deed Records , Kane County, Illinois . (Located South
of Eastview Street and East of Route 25.)
Section 2 . That said grant of special use as afore-
said shall automatically be void and of no force and effect,
unless the construction of said microwave tower is commenced
within a period of six months from the passage of this or-
dinance, all without further Council action.
Section 3 . That all ordinances or parts thereof in
conflict herewith be, and the same hereby are , repealed
and of no further force and effect.
Section 4. That this ordinance shall be in full force
and effect from and after its passage as provided by law
and shall be published in pamphlet form by authority of the
City Council.
