G-1535 Ordinance No. G-1535 AN ORDINANCE AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN, ILLINOIS, ENTITLED, "THE ELGIN ZONING ORDINANCE". WHEREAS, a public hearing has been duly held pursuant to the Statutes of the State of Illinois, and the provisions of the Elgin Zoning Ordinance, and WHEREAS, the Elgin Zoning Board of Appeals has transmitted its recommendations to the City Council, all of which have been duly considered. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Sub-Section B of Section 21-106 of Chapter 21 of the City Code of Elgin, Illinois, as amended, be, and the same hereby is, amended by add- ing thereto, the following paragraph: That the boundaries hereinbefore described and laid out in the "Zoning District Map", as amended, be and they hereby are, altered by including in M-1 Limited Manufacturing District, the following described premises: PARCEL A That part of the Southwest quarter of the Northeast quarter of Section 32, Township 42 North, Range 8 East of the Third Principal Meridian described as follows: Commencing at the Southwest corner of said Northeast quarter; thence Northerly along the West line of said Northeast quarter, a distance of 612.60 feet to the Southerly right of way line of the Northwest Toll Highway; thence Southeasterly, along said Southerly right of way line, which forms an angle of 59 degrees 58 minutes measured counter-clockwise from the West line of said Northeast quarter, a distance of 1017.29 feet for the place of beginning; thence continuing Southeasterly, along said Southerly right of way line, a distance of 209.35 feet to the South line of said Northeast quarter; thence Westerly, along said South line, a distance of 181.09 feet to a point on a line which is parallel with the West line of said Northeast quarter and which passes through the place of beginning; thence Northerly, along said parallel line, a distance of 104.47 feet to the place of beginning. Being situated in Dundee Township, Kane County, Illinois, and containing 0.217 Acre more or less. PARCEL B That part of the Southwest quarter of the Northeast quarter of Section 32, Township 42 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning at the Southwest corner of said Northeast quarter; thence Northerly, along the West line of said Northeast quarter, a distance of 612.60 feet to the Southerly right of way line of the Northwest Toll Highway; thence Southeasterly, along said Southerly right of way line, which forms an angle of 59 degrees 58 minutes measured counter-clockwise from the West line of said Northeast quarter, a distance of 1017.29 feet; thence Southerly, parallel with the West line of said Northeast quarter, a distance of 104.47 feet to the South line of said Northeast quarter; thence Westerly, along said South line, a distance of 880.85 feet to the place of beginning. Being situated in Dundee Township, Kane County, Illinois, and containing 7.250 Acres more or less. Section 2. That said territories hereinbefore described be and they hereby are included in the M-1, Limited Manufacturing District as set forth in the Elgin Zoning Ordinance (Chapter 21 of the City Code of Elgin, Illinois) as amended, expressly subject to the terms and conditions of that certain Annexation Agreement dated August 9, 1972, by and between the City of Elgin as "City" and Harris Trust and Savings Bank (Trust #34431) as "Owners". If construction of an approved planned unit development has not commenced upon expiration of the terms and conditions of the aforesaid annexation agreement, the zoning of the herein described territory shall revert to the R-2 single family residence district' as set forth in the Elgin Zoning Ordinance. Section 3. That all ordinances or parts thereof in conflict herewith be, and the same hereby are, repealed and of no further force and effect. Section 4. That this Ordinance shall be in full force and effect from and after its passage as provided by law and shall be published in pamphlet form by authority of the City Council. s/ , E. a suscheuberger W.
