G-1532 Ordinance No. G-1532 AN ORDINANCE AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN, ILLINOIS, ENTITLED, "THE ELGIN ZONING ORDINANCE". WHEREAS, a public hearing has been duly held pursuant to the Statutes of the State of Illinois, and the provisions of the Elgin Zoning Ordinance, and WHEREAS, the Elgin Zoning Board of Appeals and the Plan Commission of the City of Elgin have transmitted their recommendations to the City Council, all of which have been duly considered. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Sub-Section B of Section 21-106 of Chapter 21 of the City Code of Elgin, Illinois, as amended, be, and the same hereby is, amended by adding thereto, the following paragraph: That the boundaries hereinbefore described and laid out in the "Zoning District Map", as amended, be, and they hereby are, altered by including in R-4, General Residence District, the following described premises: PARCEL I: That part of the West half of Fractional Section 3, and the East half of Fractional Section 4, Township 41 North, and the Southeast quarter of Section 32 and the Southwest quarter of Section 33, Township 42 North, all in Range 8 East of the Third Principal Meridian described as follows: Beginning at the inter- section of the North line of the West half of said Fractional Section 3 with the center line of Sleepy Hollow Road; thence Southerly, along said center line, a distance of 1064.0 feet to the Northeast corner of land conveyed to the Northern Illinois Gas Company; thence Westerly, along the Northerly line of said Northern Illinois Gas Company land, a distance of 1818.80 feet to the Northwest corner of said Northern Illinois Gas Company land; thence Northerly, at right angles to said Northerly line, a distance of 1080.45 feet to the North line of the East half of said Fractional Section 4, being also the South line of the Southeast quarter of said Section 32; thence Westerly, along the South line of the Southeast quarter of said Section 32, a distance of 942.05 feet to the Southwest corner of said Southeast quarter; thence Northerly, along the West line of said Southeast quarter, a distance of 942.05 feet to the Southwest corner of said Southeast quarter; thence Northerly, along the West line of said Southeast quarter, a distance of 741.5 feet; thence North 86 degrees 48 minutes East, a distance of 2566.41 feet to the center line of Sleepy Hollow Road; thence Southeasterly, along said center line, a distance of 998.19 feet to the South line of the Southwest quarter of said Section 33 and the place of beginning. Being situated in Elgin and Dundee Townships, Kane County, Illinois and containing 91 Acres more or less. PARCEL II: That part of the Southeast quarter of Section 32, Township 42 North, Range 8 East of the Third Principal Meridian described as follows: Commencing at the Southwest corner of the Southeast quarter of said Section 32; thence Northerly, along the West line of said Southeast quarter, a distance of 741.5 feet for the place of beginning; thence North 86 degrees 48 minutes East, a distance of 2566.41 feet to the center line of Sleepy Hollow Road; thence Northwesterly, along said center line, a distance of 729.71 feet to the Southerly right of way line, as monumented, of Parcel No. N-4D-59, as acquired by the Illinois State Toll Highway Commission through proceedings filed in the Circuit Court of Kane County; thence Northwesterly, along said Southerly right of way line, as monumented, a distance of 683.3 feet to a jog in said Southerly right of way line; thence Northeasterly, along said jog, as monumented, being at right angles to the last described course, a distance of 2000 feet; thence Northwesterly, along said Southerly right of way line, as monumented, being at right angles to the last described course, a distance of 1134.12 feet to the North line of the Southeast quarter of said Section 32; thence Westerly, along said North line, a distance of 861.88 feet to the Northwest corner of said Southeast quarter; thence Southerly, along the West line of said Southeast quarter, a distance of 1894.3 feet to the place of beginning. Being situated in Dundee Township, Kane County, Illinois and containing 83.546 Acres more or less. Section 2. That said territories hereinbefore described be and they hereby are included in the R-4, General Residence District, as set forth in the Elgin Zoning Ordinance (Chapter. 21 of the City Code of Elgin, Illinois) as amended, expressly subject to the terms and conditions of that certain Annexation Agreement dated July 26, 1972 by and between the City of Elgin, as "City" and Mary Wells Patrick as "Owner" and Miller-Davis Realty Company, A corporation, as "Buyer". If construction of an approved planned unit development has not commenced upon expiration of the terms and conditions of the aforesaid annexation agreement, the zoning of the herein described territory shall revert to the R-2 single family residence district as set forth in the Elgin Zoning Ordinance. Section 3. That a Special Use for a Planned Unit Development upon the above described real estate is granted and authorized, subject, however, to the strict compliance by the petitioners, their successors or assigns, with the terms and conditions of the above described Annexation Agreement dated July 26, 1972, and the provisions, regulations and procedures set forth in Section 21-111 of Chapter 21 of the City Code of Elgin, Illinois, pertaining to the establishment and development of a Planned Unit Development. Section 4. That all ordinances or parts thereof in conflict herewith be, and the same hereby are, repealed and of no further force and effect. Section 5. That this Ordinance shall be in full force and effect from and after its passage as provided by law and shall be published in pamphlet form by authority of the City Council. s/ W. E.
