G-1527 Ordinance No . G-1527 AN ORDINANCE GENERALLY AMENDING ARTICLE V OF CHAPTER 18 OF THE CITY CODE PERTAINING TO THE LICENSING AND CONTROL OF DOGS WITHIN THE CITY OF ELGIN . - BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ELGIN , ILLINOIS : Section 1 . That Article V of Chapter 18 of the City Code of Elgin be , and it hereby is , amended by repealing present Article V thereof in its entirety , and inserting in lieu thereof the following new Article V , to-wit: ARTICLE V - Dogs 501 . Rabies , Inoculation and license required 502 . License fees 503 . Dangerous dogs 504. Dogs at Large 505 . Disturbing the Peace 506 . Nuisances 507 . Animal Control Officer 508. Fees for Impounding and Keeping 509 . Public Notice of Impounding 510 . Notice to Owners of Licensed Dogs 511 . Animal Bites 512 . Suspected Rabies 513 . Prohibited Areas 514 . Penalties 18-501 . Rabies Inoculation and License Required . No dog shall be permitted to be or remain in the City unless properly inoculated for rabies as provided by Section 23( i ) of Chapter 8 of the Illinois Revised Statutes , and unless being licensed by the City as hereinafter provided . 18-502 . Licens'e Fees . All dogs kept in the City shall be registered as to sex , breed , name and address of owner and name of dog. At the time of such registration such owner shall obtain a license for such dog and shall pay the following fees : Annual registration fee , Male dog $1 .00 ; Female Dog $2 .00 ; Spayed Dog , $1.00 . Said fees shall be paid to the City Treasurer who shall , (a) keep a register of dogs ; (b) deliver a license tax to such owner. Expressly , provided , however, that prior to issuing a license for any such dog , the City Treasurer shall , require that the owner to exhibit a certificate in the form approved by the Department of Agriculture of the State of Illinois , indicating that such dog was inoculated not more than one year prior to the date of application for such license. It shall be the duty of said owner to cause such license tag to be securely attached around the dog ' s neck and kept there at all times during the license period . i. Any license purchased after July 1st , in any year , for tow that particular calendar year , shall be subject to a penalty of , and shall cost , $3 .00 in addition to the normal license fee ; expressly provided however , that the person owning the dog for which the license is being purchased has owned said animal for at least six months on the date the license is applied for , 18-503 . Dangerous Dogs . No vicious , dangerous , ferocious dog or dog sick with or liable to communicate hydrophobia or other contagious or infectious disease shall be permitted to run at large in the City . 18-504. Dogs at Large . No person shall cause or permit any dog owned or kept by him to be at large at any place within the City , other than on the property of such owner or keeper , unless such dog is securely fastened and restrained by a leash . Any dog , not upon the owner ' s or keeper ' s property , which is not fastened and restrained by a leash shall be deemed as being at large . All dogs found being at large , whether or not currently licensed by the City of Elgin shall promptly be impounded . 18-505 . Disturbing the Peace . No person owning any dog shall suffer or permit such dog to disturb thepeace and quiet of the neighborhood by barking , making other loud or unusual noises , or by running thru or across cultivated gardens or '' fields . 18-506 . Nuisances . ( a) Any dog found in the City , either with or without a license , being at large under conditions set forth above , is hereby declared to be a nuisance and shall be impounded as hereinafter provided . (b) It shall be deemed to be a public nuisance for any person to cause or permit any dog owned or kept by him to defecate or urinate upon any public street , sidewalk , or other public place , or upon any premises not owned or controlled by the person owning or keeping the dog , provided however that shall any such defecation be completely and promptly removed by the owner or keeper of said dog, the terms of this Section shall not be found applicable . 18-507 . Animal Control Officer . There is hereby created the position of Animal Control Officer . The Animal Control Officer is hereby charged with the duty of impounding all dogs being at large in violation of the provisions of this article . He shall be a special police officer and shall be , and is , hereby authorized to make all necessary arrests in carrying out the provisions of this article . . . '• 18-508. Fees for Impounding and Keeping . ( a) Licensed Dogs . Any dog for which the license fee for the current year has been paid , which may during such year be impounded or taken up for being at large , may be redeemed by the owner or keeper of such dog upon payment of a fee to the City of Elgin of five dollars ($5 .00) for the first redemption , ten dollars ( $10 . 00) for the second redemption and twenty dollars ( $20 .00) for the third redemption , for the taking up or impounding of such dog and in addition paying the cost of keeping such dog while impounded . If such dog is without a collar or harness with a current license attached , it shall be deemed a licensed dog , for the purpose of this section , if satisfactory proof is given to a police officer, or the animal control officer , by the owner or keeper that such dog is licensed and that a collar , or harness with a current license tag attached thereto was placed on such dog, but had subsequently been lost , or taken from such animal . (b ) Unlicensed dogs . Any unlicensed dog which shall have been impounded may be redeemed by the owner or keeper of such dog upon payment to the City of Elgin of the sum of ten dollars ( $10 .00) for the first redmmption , fifteen dollars ($15 .00) for the second redemption , and twenty-five r dollars ($25 .00) for the third redemption , as a fee for taking up or impounding such dog, plus the annual license fee provided in section 18-502 , of this Article , and the cost of keeping such dog while impounded . 18-509 . Public Notice of Impounding . Immediately after impounding any dog hereunder, it shall be the duty of the Animal Control Officer to record the date of impounding , a description of the dog impounded , and a record as to whether or not such dog has been licensed and tagged as required by the ordinance. Public notice of the impounding of such dog shall be given by posting a description of such dog and date of impounding at the place of impoundment. Any such dog not redeemed by the owner or keeper thereof within three days after the posting of such notice by the Animal Control Officer shall be and is hereby declared to be a public nuisance . Immediately _thereafter such dog shall be disposed of by the person so designated . 18-510 . Notice to Owners of Licensed Dogs . It shall be the duty of the Animal Control Officer to cause notice to be served by registered , or certified mail , return receipt requested , upon the registered owner of any licensed dog r impounded under the provisions of this article, such notice to be mailed to the last known address of the owner, at least three days prior to the posting of public notice of impounding hereinbefore provided . - . e 18-511 . Animal Bites . ( a) It shall be unlawful for the owner or keeper of any dog or other animal when notified that such dog or animal has bitten or scratched any person or has otherwise injured any person so as to cause an abrasion of the skin , to sell or give away such dog or animal or to permit or allow such dog or animal to be taken away beyond the limits of the country , but it shall be the duty of such owner, upon receiving notice of the character aforesaid to immediately place such dog or animal in a duly licensed veterinary hospital where such dog or animal shall be confined for a period of at least ten days for observation or deliver, or cause to be delivered , any such dog or animal to the Animal Control . Officer for such placement. In case such dog or animal is delivered to a veterinary hospital , notice of the name and location of such hospital shall be immediately furnished to the Animal Control Officer by the owner of such dog or animal , and upon receipt of such dog or animal , the veterinary hospital shall submit to the Animal Control Officer, a certificate stating that such dog or animal either shows . no symptoms of rabies or does show symptoms of rabies . If, at the expiration of the ten days of confinement in such veterinary hospital , the veterinary hospital shall submit to the Animal Control Officer a second certificate stating that the dog or animal does not have rabies , the dog or animal may then be released by the Animal Control Officer. ( b) If, however, evidence is presented that such dog or animal has been inoculated against rabies within the time prescribed by law prior to the biting , such dog or animal shall be confined in the house of its owner or in a manner that will 'prohibit such dog or animal from biting any person for a period - of ten days , unless in the judgment of the Animal Control Officer , Rabies Inspector, or the licensed veterinarian circumstances are such that the dog or- animal should be confined elsewhere . - Such dog or animal so confined shall be examined by a licensed veterinarian on the first , fifth , and tenth day during confinement. If, at the expiration of the ten days of confinement the veterinarian shall submit a certificate stating that the dog or animal- does not have rabies the dog or animal may then be released by the Animal Control Officer. 18-512 . Suspected Rabies . The owner or custodian of any dog or other animal suffering from, or suspected to be suffering from , rabies as provided in this ordinance shall surrender possession of ,such dog or animal to the Animal Control Officer or any police officer - of,-.the City on demand . 18-513 . Prohibited Areas . It shall be unlawful for any dog , even though on a lease , to go or be upon any - school premises , public playground , public swimming pool or public park within the City or upon a path or sidewalk extending through .or within any school premises , public playground, or public park within the City. • 18-514 . Penalties . Any person violating any provision of this Ordinance shall be subject to a fine or penalty not to exceed five hundred dollars ( $500.00) for each offense and a like fi ne for each .day such violation continues . Section 2 . That all ordinances or parts thereof in conflict herewith be , and the same hereby are , repealed and of no further force and effect. Section 3 .
