AN ORDINANCE
AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN , ILLINOIS ,
ENTITLED "THE ELGIN ZONING ORDINANCE " .
WHEREAS , a public hearing has been duly held pursuant
to the Statutes of the State of Illinois , and the provisions
of the Elgin Zoning Ordinance , and
WHEREAS , the Elgin Zoning Board of Appeals has transmitted
its recommendations to the City Council , all of which have been
duly considered .
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ELGIN , ILLINOIS :
Section 1 . That Sub-Section B of Section 21- 106 of
Chapter 21 of the City Code of Elgin , Illinois , as amended ,
be , and the same hereby is , amended by adding thereto ,
the following paragraph :
That the boundaries hereinbefore described and laid
out in the "Zoning District Map" , as amended , be ,
and they hereby are , altered by including in M- 1 ,
Limited Manufacturing District, the following described
premises :
That part of the Southeast quarter of Section 4 , Township
41 North , Range 8 East of the Third Principal Meridian ,
described as follows : Commencing at the point of
intersection of the center line of Sleepy Hollow road with
the Northerly right of way line of the Chicago , Milwaukee ,
St . Paul and Pacific Railroad Company ; thence South 89
degrees 19 minutes West along said Northerly right of way
line 1446 . 7 feet to the original center line of the Huntley
Road ; ( Big Timber Road) for the place of beginning ; thence
North 56 degrees 49 minutes West along said center line
1889 . 29 feet; thence South 16 degrees 13 minutes West
796 . 57 feet to the Northerly line of said Railroad right
of way ; thence Southeasterly along said Northerly right
of way line , a distance of 1825 . 16 feet to the place of
beginning , also that part of Huntley Road ( Big Timber
Road) lying Easterly of the Westerly line extended
Northerly of the aforedescribed property and lying
Westerly of the Westerly line of property now owned by
the Northern Illinois Gas Company , EXCEPT that part
heretofor annexed by Ordinance No . 5837 passed
September 8, 1966 in the Township of Elgin , Kane County ,
Illinois .
SECTION 2 . That said territories hereinbefore described
be and they hereby are included in the M- 1 , Limited Manufacturing
District as set forth in the Elgin Zoning Ordiance ( Chapter 21
of the City Code of Elgin , Illinois ) as amended , expressly
subject to the terms and conditions of that certain Annexation
Agreement dated May 24 , 1972 , by and between the City of Elgin
as "City" and John E. Traeger and Karen M . Traeger , his wife ,
Valley Engineering Company , an Illinois corporation , Roy 0 .
Howard and Harig Products , Inc. , an Illinois corporation as
"Owners " .
Section 3 . That all ordinances or parts thereof in
conflict herewith be , and the same hereby are , repealed and
of no further force and effect.
Section 4 . That this Ordinance shall be in full force
and effect from and after its passage as provided by law
and shall be published in pamphlet form by authority of the
City Council .
