AN ORDINANCE
AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN , ILLINOIS ,
ENTITLED "THE ELGIN ZONING ORDINANCE" TO CHANGE THE ZONING
CLASSIFICATION OF CERTAIN PROPERTY FROM M- 1 , LIMITED
MANUFACTURING DISTRICT TO B-4 , GENERAL SERVICE BUSINESS
DISTRICT AND AUTHORIZING A SPECIAL USE THEREON FOR A
AUTOMOBILE SERVICE STATION AND FOR TRAILER AND TRUCK RENTAL .
WHEREAS , the City Council has been requested to reclassify
certain property in the City of Elgin , hereinafter described ,
from M-1 , Limited Manufacturing District, to B-4 , General
Service Business District, and to authorize thereon a special
use as an automobile service station with trailer and truck
rental , pursuant to provisions of Chapter 21 of the
City Code of Elgin , Illinois , entitled "The Elgin Zoning
Ordinance" , and
WHEREAS , a written report has been prepared and forwarded
to the Zoning Board of Appeals and the City Council by the Plan
Commission of the City of Elgin pertaining to this particular
petition , and
WHEREAS , a public hearing has been duly held by the Zoning
Board of Appeals of the City of Elgin after due notice by
publication , as provided by statute , and its findings and
recommendations have been reported to the City Council , and
WHEREAS , the City Council has determined that such Special
Use requested is necessary for the public convenience , can be
designed , located and operated so that the public health , safety
and welfare will be protected , and will not cause substantial
injury to the value of the other property in the neighborhood
in which it is located and therefore , should be granted .
NOW , THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF ELGIN , ILLINOIS :
Section 1 . That Sub-Section B of Section 21- 106 of
Chapter 21 of the City Code of Elgin , Illinois , as amended ,
be , and the same hereby is , amended by adding thereto ,
the following paragraph :
That the boundaries hereinbefore described and laid
out in the " Zoning District Map" , as amended , be ,
and they hereby are , altered by excluding from
M-1 , Limited Manufacturing District , and including
in B-4 , General Service Business District , the
following described premises :
The West 52 feet of Lot 59 and all of Lot 60 of
P . J . Kimball Jr . ' s Second Addition to Elgin , and
the West 118. 0 feet of the South 19 . 0 feet of Lot
4 in Block 8 of P . J . Kimball Jr . ' s Third Addition
to Elgin , in the City of Elgin , Kane County , Illinois .
Section 2 . That a Special Use as an automobile service
station with trailer and truck rental permitted, pursuant
to the provisions of Chapter 21 of the City Code of Elgin , Illinois ,
entitled "The Elgin Zoning Ordinance" be, and the same hereby
is , authorized to be established upon the above described
real estate .
Section 3 . That the aforesaid Special Uses are granted
upon the express condition that all off-street parking and
storage areas will be surfaced in accordance with city
specifications as approved by the Department of Engineering
& Inspection .
Section 4 . That all ordinances or parts thereof in
conflict herewith be , and the same hereby are , repealed and
of no further force and effect.
Section 5 That this ordinance shall be in full force
and effect from and after its passage as provided by law and
shall be published in pamphlet form by authority of the City
Council .
