G-1480 Ordinance No , G-1480 AN ORDINANCE AUTHORIZING A SPECIAL USE AS AN AUTOMOBILE SERVICE STATION , TO BE ESTABLISHED ON CERTAIN PROPERTY IN THE CITY OF ELGIN , PURSUANT TO THE PROVISIONS OF CHAPTER 21 OF THE CITY CODE OF ELGIN , ILLINOIS , ENTITLED "THE ELGIN ZONING ORDINANCE " . WHEREAS , the City Council has been requested to authorize a Special Use as an automobile service station upon certain property , hereinafter described in the City of Elgin , and WHEREAS , said property is zoned B-4 , General Service District , under the provisions of the Elgin Zoning Ordinance , and WHEREAS , a written report has been prepared and forwarded to the Zoning Board of Appeals and the City Council by the Plan Commission pertaining to this particular petition , and WHEREAS , a public hearing has been held by the Zoning Board of Appeals after due notice by publication , as provided by Statute , and its findings and recommendations have been reported to the City Council , and WHEREAS , the City Council has determined that such Special Use requested is necessary for the public convenience , can be designed , located and operated so that the public health , safety and welfare will be protected , and will not cause substantial injury to the value of the other property in the neighborhood in which it is located and , therefore , should be granted . NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN , ILLINOIS : Section 1 . That a Special Use as an automobile service station be , and the same hereby is , authorized pursuant to the provisions of Chapter 21 of the City Code of Elgin , Illinois , entitled "The Elgin Zoning Ordinance" on the following described real estate , to-wit : That part of the NW quarter of Seca 22 , T 41 N , R8 East of the 3rd Principal Meridian described as follows : Commencing at the SW corner of the NW quarter of said Sec , 22; thence Northerly along the Westerly line of said NW quarter , 1048 . 67 feet; thence Easterly parallel with the South line of said NW quarter , 1725 . 33 feet to the Northerly right-of-way line of Federal Aid Rt - 6 ( U0S . Route 20 By-Pass ) ; thence Southeasterly along said Northerly right-of-way line , 203 . 65 feet for the point of beginning ; thence Easterly along a curve to the left having a radius of 333 . 0 feet and being tangent to the last described course , 153 . 92 feet ; thence Easterly tangent to the last described curve and parallel with the South line of the NW quarter of said Sec . 22 , 364 . 13 feet; thence Southerly at right angles to said parallel line , 142 .09 feet to the Northerly right-of-way line of Federal Aid Rt., 6 ( U . S . Route 20 By-pass ) ; thence Northwesterly along said Northerly right-of-way line , 6 . 48 feet ; thence continuing Northwesterly along said Northerly right-of-way line , being along a curve to the right having a radius of 1594 . 29 feet; and being tangent to the last described course 445 . 62 feet ; thence continuing Northwesterly along said Northerly right-of-way line, being along a curve to the right having a radius of 6216 26 feet and being tangent to the last described curve , 83 . 17 feet, thence continuing Northwesterly along said Northerly right-of-way line being tangent to the last described curve , 9 . 65 feet to the place of beginning in the City of Elgin , Kane County , Illinois , Section 2 . That the Special Use for a automobile service station upon the above described real estate is granted and authorized upon the following described conditions , to-wit : 1 . That no more than two ( 2 ) gasoline pumps shall be permitted ; 2 . That the sale of automobile accessories , tires , recreational vehicles or other products , shall be prohibited ; it being understood that the primary use of said automobile service station facilities is intended to be in conjunction with the existing car wash on the premises ; 3 . That the Owner shall install a " right turn only on exit" sign for traffic exiting on Main Lane from the car wash established on the premises . Section 3 . That all ordinances or parts thereof in conflict herewith be , and the same hereby are , repealed and of no further force and effect , Section 4 . That this ordinance shall be in full force and effect from and after its passage as provided by law and shall be published in pamphlet form by authority of the City Council . s/ W. E.
