AN ORDINANCE
AUTHORING A SPECIAL USE AS A CHURCH TO BE ESTABLISHED ON
CERTAIN PROPERTY IN THE CITY OF ELGIN , PURSUANT TO THE
PROVISIONS OF CHAPTER 21 OF THE CITY CODE OF ELGIN ,
ILLINOIS , ENTITLED "THE ELGIN ZONING ORDINANCE " .
WHEREAS , the City Council has been requested to
authorize a Special Use for the development and maintenance
of a church upon certain property , hereinafter described , in
the City of Elgin , and
WHEREAS , said property is zoned R-2 , Single Family
Residence District , under the provisions of the Elgin
Zoning Ordinance , and
WHEREAS , a written report has been prepared and forwarded
to the Zoning Board of Appeals and the City Council by the Plan
Commission pertaining to this particular petition , and
WHEREAS , a public hearing has ben held by the Zoning
Board of Appeals after due notice by publication , as provided
by Statute , and its findings and recommendations have been
reported to the City Council , and
WHEREAS , the City Council has determined that such Special
Use requested is necessary for the public convenience , can be
designed , located and operated so that the public health ,
safety and welfare will be protected , and will not cause
substantial injury to the value of the other property in the
neighborhood in which it is located and , therefore , should be
granted .
NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ELGIN , ILLINOIS :
Section 1 . That a Special Use for the development and
maintenance of a church be , and the same hereby is , authorized
pursuant to the provisions of Chapter 21 of the City Code of
Elgin , Illinois , entitled "The Elgin Zoning Ordinance" on the
following described real estate , to-wit :
Outlot A of Country Knolls , Unit No , 6 , in the
City of Elgin , Kane County , Illinois .
Section 2 . That said Special Use for a church upon the
above described real estate is granted and authorized upon the
following described conditions , to-wit:
1 . That prior to the issuance of a building permit , plans
shall be submitted to, and approved by , the Department of Engineering
and Inspection for the proper screening and drainage facilities
for the required off-street parking lot .
2 . That at the time of application for a building
permit , in the event that additional off-street parking
facilities are to be acquired on adjacent school district
property , a copy of the agreement between the church and
the said school district providing for use of said property
for additional off-street parking facilities shall be
submitted to the Department of Building & Inspection of
the City of Elgin .
Section 3 . That all ordinances or parts thereof in conflict
herewith be , and the same hereby are , repealed and of no further
force and effect .
Section 4 . That this ordinance shall be in full force
and effect from and after its passage as provided by law and
shall be published in pamphlet form by authority of the
City Council .
