AN ORDINANCE
AMENDING ARTICLE IX OF CHAPTER 19 OF THE CITY CODE OF
ELGIN , ILLINOIS , ENTITLED ELGIN HOUSING CODE" TO ADOPT
BY REFERENCE THE SECOND ADDITION , BASIC HOUSING CODE ,
PUBLISHED BY THE BUILDING OFFICIALS AND CODE ADMINISTRATORS
INTERNATIONAL , INC . , IN 1970 .
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ELGIN ,
ILLINOIS :
Section 1 . That Article IX of Chapter 19 of the City
Code of Elgin , Illinois , be , and the same hereby is , amended
in the following manner, to-wit :
a . By repealing Section 19-902 of said Article IX in
its entirety and inserting in lieu thereof the following , to-wit :
19-902 . Adoption of Basic Housing Code .
There is hereby adopted by the City of Elgin , for the purpose
of accomplishing the title and scope of this Code , that certain
housing code known as "The Second Addition to the Basic Housing
Code , " published by the Building Officials and Code Administrators ,
International , Inc . , in 1970 , save and except such portions as
are hereinafter deleted , modified or amended , of which not less
than three ( 3) copies have been and now are filed in the Office
of the City Clerk of the City of Elgin and the same are hereby
adopted and incorporated as fully as if set out at length
herein , and from the date on which this Ordinance shall take
effect , the provisions thereof shall be controlling in the
regulation of all housing facilities contained within the
corporate limits of the City of Elgin .
b . That Section 19-903 of said Article IX be , and it
is , amended by adding thereto the following additional paragraph :
"Where the provisions of this Section 19-903 may
conflict with the provisions set forth in the basic Housing
Code , adopted by reference , the provisions of this Section 19-903 ,
shall prevail and be controlling and shall be considered an
Amendment to any conflicting provisions contained in said basic
Housing Code .
c . That Sections 19-905 through 19-911 , both inclusive ,
be , and the same hereby are , repealed and of no further
force and effect , and that Section 19-912 be , and the same hereby
is , renumbered and designated as Section 19-905 .
Section 2 . That all ordinances or parts thereof in
conflict herewith be , and the same hereby are , repealed and
of no further force and effect .
Section 3 . That this Ordinance shall be in full force
and effect from and after its passage as provided by law and
shall be published in pamphlet form by authority of the City
Council .
