AN ORDINANCE
AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN , ILLINOIS , ENTITLED
rw "THE ELGIN ZONING ORDINANCE" AS PERTAINS TO AUTOMOBILE SERVICE
STATIONS .
WHEREAS , in the opinion of the City Council the location
of automobile service stations in the City of Elgin should be
more stringently regulated and controlled , so that the public
health , safety and welfare will be protected and such uses
will not cause substantial injury to the value of other property
in the neighborhood in which they are located , and
WHEREAS , a public hearing has been duly held pursuant to
Statutes of the State of Illinois and the provisions of the
Elgin Zoning Ordinance , and
WHEREAS , the Elgin Zoning Board of Appeals has transmitted
its recommendations to the City Council , all of which have been
duly considered .
NOW , THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF ELGIN , ILLINOIS :
Section 1 . That automobile service stations be , and the
same hereby are , deleted as a permitted use under the provisions
of the Elgin Zoning Ordinance and that Chapter 21 of the City
Code of Elgin , Illinois , as amended, be , and the same hereby is ,
amended by deleting from the permitted uses set forth in
e paragraph ( 2) entitled " Permitted Uses" of Sub-section D of
Section 21-108, the following use, to-wit:
"e; - Automobile Service Stations "
Section 2 . That the estblishment and operation of
automobile service stations be , and the same hereby is , made a
Special Use under the provisions of the Elgin Zoning Ordinance ,
and that Sub-section D of Section 21-108 of Chapter 21 of the City
Code of Elgin , Illinois , be , and the same hereby is , amended
by including in the Special Uses permitted in paragraph ( 3)
of said Sub-section D , the following additional Special Use , to-wit :
"e - Automobile Service Stations "
Section 3 . That all ordinances or parts thereof in conflict
herewith be , and the same hereby are , repealed and of no further.
force and effect .
Section 4 . That this ordinance shall be in full force and
effect from and after its passage as provided by law and shall
be published in pamphlet form by authority of the City Council .
