G-1428 Ordinance No , G-1428 AN ORDINANCE AMENDING CHAPTER 21 OF THE CITY CODE OF ELGIN , ILLINOIS , ENTITLED "THE ELGIN ZONING ORDINANCE" , TO ELIMINATE RESIDENTIAL USES IN AREAS ZONED FOR COMMERCIAL AND MANUFACTURING PURPOSES AND TO ELIMINATE COMMERCIAL USES IN AREAS ZONED FOR MANUFACTURING PURPOSES . WHEREAS , it is in the best interest of the general public that the Elgin Zoning Ordinance be amended to prohibit the further intermixing of residential , commercial and manufacturing uses within one zoning district , and WHEREAS , a public hearing has been duly held pursuant to the Statutes of the State of Illinois and the provisions of the Elgin Zoning Ordinance , and WHEREAS , the Elgin Zoning Board of Appeals has transmitted its recommendations to the City Council , all of which have been duly considered . NOW , THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ELGIN , ILLINOIS : Section 1 . That in order to eliminate the further development of residential uses within property zoned for commercial purposes , Chapter 21 of the City Code of Elgin , Illinois , as amended , be , and the same hereby is , amended in the following manner , to-wit : a . By amending Sub-section B of Section 21-108 of said Chapter 21 by deleting from the permitted uses set forth in paragraph ( 2) entitled " PERMITTED USES" the following : "x . Dwelling units and lodging rooms - In accordance with regulations set forth in ' 1A . General Conditions ' of this District " b . By amending Sub-section B of Section 21-108 of said Chapter 21 by eliminating therefrom said paragraph ( 6) entitled " (6) LOT AREA FOR DWELLING UNITS" in its entirety . c . By amending Sub-section C of said Section 21-108 of said Chapter 21 by eliminating therefrom sub-paragraph ( 6) entitled " (6) LOT AREA FOR DWELLING UNITS" in its entirety . Section 2 , That in order to eliminate the further development of residential and commercial uses within property zoned for manufacturing purposes , Chapter 21 of the City Code of Elgin , Illinois , as amended , be , and the same herby is , amended in the following manner , to-wit: e a . By amending Paragraph ( 1 ) entitled "Permitted Uses " of Sub-section B of Section 20- 109 of said Chapter 21 by deleting the present paragraph ( 1 ) in its entirety and inserting in lieu thereof , the following , to-wit : ( 1 ) PERMITTED USES . a . Any use concerned with the operation of establishments for the manufacturing , assembly , disassembly , fabricating , repairing , storing , cleaning , servicing , or testing of materials , goods , or products , provided operation of such use conforms with applicable regulations and performance standards for the M1 District heretofore set forth in General Requirements Al to A5 of this Section and regulations set forth elsewhere in this ordinance. b . Laboratories ( research and testing) c . Offices (when necessary as part of or associated with the manufacturing plant) d . Contractors establishments - including both those operated within enclosed buildings and those with outside storage with fenced enclosures . e . Cartage and express facilities including outside storage of motor trucks and truck trailers . f . Storage , warehousing and wholesale establishments g . Packaging and crating . h . Building material sales and storage . i . Printing and publishing establishments . b . By amending paragraph ( 2) entitled " ( 2) Special Uses . " of Sub-section B of Section 20-109 of said Chapter 21 by deleting the present paragraph ( 2) in its entirety and inserting in lieu thereof the following , to-wit : ( 2) SPECIAL USES . a . Planned developments , manufacturing - on tracts of land not less than 40 acres in area . b . Airports . c . Utility and public services , including : 1 . Bus turnarounds - off-street; 2 . Electric distributions centers ; 3 . Fire stations ; 4 . Gas regulators ; 5 . Police stations ; 6 . Railroad rights of way ; 7 . Transit and public transportation facilities , including shelters , terminals , parking areas and service buildings ; 8 . Telephone exchanges , micro-wave relay towers , telephone transmission equipment buildings ; ,.. 9 . Water filtration plants , pumping stations and reservoirs ; 10 . Excessory uses to the above allowable special uses , including , but not limited to off-street parking and off-street loading . d . Hotels and motels (when an intregal part of the over-all plan for an Industrial Park) e . Parking lots and storage areas , ( other than when associated with a specific use) f . Radio and television transmission towers and transmission equipment buildings ; g . Restaurant (when an intregal part of the over-all plan for an Industrial Park) - It is not the intention of this provision to prohibit the establishment of employee food serving facilities within buildings erected for manufacturing purposes . h . Garages , public . Section 3 . That the provisions of this Ordinance , insofar as they would prohibit a use presently permitted under the Elgin Zoning Ordinance , prior to this Amendment , shall not apply to eft existing buildings or subdivided lots , zoned in a commercial or manufacturing classification within the corporate limits of the City of Elgin as of the effective date of this ordinance . Section 4 . That all ordinances in conflict herewith be , and the same hereby are , repealed and of no further force and effect . Section 5 . That this ordinance shall be in full force and effect from and after its passage as provided by law and shall be published in pamphlet form by authority of the City Council . E. C.
