e Ai' ORDINANCE VACATING A PORTION OF DAVIS ROAD , A PUBLIC STREET IN MILLER-
DAVIS RESEARCH INDUSTRIAL CENTER IN THE CITY OF ELGIN , KANE
COUNTY , ILLINOIS .
WhEREAS , a certain portion of a public street located and
platted in Miller-Davis Research and Industrial Center , a
subdivision in the City of Elgin , Kane County , Illinois has
never been improved , maintained or used for street purposes , and
WHEREAS , the public interest will be sub-served by the
vacation of the following described portion of said public street ,
to-wit :
That part of Davis Road as platted in Miller-Davis
Research and Industrial Center , being a subdivision
of part of Fractional Section 2 , Township 41 North ,
and part of Sections 33 and 34 , Township 42 North ,
all in Range 8 East of the Third Principal Meridian ,
according to the plat thereof recorded in the Recorder ' s
Office of Kane County on April 17, 1970 , as Document
No . 1152317 , described as follows : Commencing at the
Southwest corner of Lot 6 in said Miller-Davis Research
and Industrial Center; thence Easterly , along the Southerly
line of said Lot 6 , being also along the Northerly
right of way line of Davis Road , a distance of 6087
eft feet for the place of beginning ; thence continuing
Easterly along an extension of the last described
course , a distance of 137 . 45 feet; thence Northwesterly ,
Westerly and Southwesterly along the Northerly right
of way line of Davis Road , being along a curve to the
left , having a radius of 75 , 0 feet , a distance of 173 , 80
feet to the place of beginning .
ALSO
That part of Davis Road , as aforesaid , described as
follows : Commencing at the Northeast corner of Lot
9 in Miller-Davis Research and Industrial Center , as
aforesaid ; thence Westerly , along the Northerly line
of said Lot 9 , being also along the Southerly right
of way line of Davis Road , a distance of 361 . 69 feet
for the place of beginning ; thence Westerly , along
an extension of the last described course , a
distance of 137 . 46 feet to the Northwest corner of
Lot 9 , as aforesaid; thence Southeasterly , Easterly
and Northeasterly along the Southerly right of way
line of Davis Road , being along a curve to the left
having a radius of 75. 0 feet , a distance of 173 . 80
feet to the place of beginning ,

NOW, THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF ELGIN , ILLINOIS :
Section 1 . That the following described portion of a
certain public street located in Miller-Davis Research and
Industrial Center in the City of Elgin , Kane County , Illinois ,
to-wit :
That part of Davis Road as platted in Miller-Davis
Research and Industrial Center , being a subdivision
of part of Fractional Section 2 , Township 41 North ,
and part of Sections 33 and 34 , Township 42 North ,

Section 2 . That the City of Elgin does hereby reserve to
itself and to any and all public utility companies owning any
public service facilities in any part of said street vacated by
this Ordinance full right of ingress and egress in and from said
street for the purpose of continuing or extending public service
facilities and for the further purpose of maintenance , renewal ,
extension or construction or reconstruction of any such public
service facilities .

Section 3 . That a certified copy of this Ordinance , together
rw. with a Plat of portion of said public street vacated be filed
with the Recorder of Deeds of Kane County , Illinois .
Section 4 . That this Ordinance shall be effective from
and after its passage as provided by law and shall be published
in pamphlet form by authority of the City Council .
